Post 44 (on page 3 the final draft before I send it to POPLA, check it out)

Hello everyone. Before I decided to create this thread I have been reading loads of them in this forum trying to find a solution to my problem. But even after that, I feel like I need to share with you this case so you can give your advise about what to do.

A letter has been sent from ParkingEye. It is a parking charge notice.
the car was parked in this "Leeds private car park" on the 28/12/16. The car staid 5hours (the maximum time offered) and the amount of 6.50 pounds was paid.

So, the receipt says Issued: 28/12/2016 at 12:29 and the car should be removed at 17:29 (5 hours). The car was removed at 17:35!

So we are talking here about 6 minutes late!

What would you do?

Thank you.

Please read the Sticky thread for NEWBIES that you seemed to have missed on the page where you clicked, New Thread.

In there you will find the BPA template in blue that you should send to parking lie AS KEEPER. You may carefully, without revealing the driver's details, add that a six minute overstay is well within the BPA CoP mandated grace periods and therefore parking lie should save themselves money by cancelling now.

Acronyms are explained in the NEWBIES.

Do not pay, do not miss the appeal deadline, do not ignore, DO NOT reveal who was driving. Find the relevant section regarding Grace Periods of the latest BPA CoP and quote that in your initial appeal.

  • Also I have realized now on that day it was freezing and when I got in the car I had to wait 3-4 minutes with the hot air on inside until I was able to see trough the windows. So it is totally disappointed how this people are expecting me to pay 100pounds

Forget about all these reasons, and what happened on the day its immaterial to greedy scamming Muppets, you are wasting your time.
The "discount" is another scam to make you cave in and pay them without a fuss , follow the advice you are being given don't pay the idiots, you have a get out with the grace period if you do it right.

None of that matters to a PPC - and any appeal reasonableness or common sense will nearly always fail.

Start by reading the Newbies Sticky mentioned above and follow the advice/templates for dealing with PE - they do work. Be careful not to identify yourself as the driver.
  • Ok I will read them and I will come back in case I have got any questions. Thanks guys

    13 Grace periods
13.1 Your approach to parking management must allow a
driver who enters your car park but decides not to park,
to leave the car park within a reasonable period without
having their vehicle issued with a parking charge notice.
13.2 You should allow the driver a reasonable ‘grace period’
in which to decide if they are going to stay or go. If the
driver is on your land without permission you should still
allow them a grace period to read your signs and leave
    before you take enforcement action.
13.3 You should be prepared to tell us the specific grace period
at a site if our compliance team or our agents ask what it is.
13.4 You should allow the driver a reasonable period to leave
the private car park after the parking contract has ended,
    before you take enforcement action

PE will probably pull out if they think you will win.
You never know how far you can go until you go too far.
