    All this talk of suing. It may well be possible but that doesn't make it any less ridiculous.

    If someone comes leaning on my walls & gets injured then it's their own bloody fault. Absolutely ridiculous that they should have any right to a claim at all.

    If it falls on them as they're walking by then fair enough but if they're the ones that go pushing on it when it isn't theirs to be messing with in the first place..? Nonsense.

    Wouldn't have gotten hurt if they'd have been able to control themselves (or their drink).

    And I guess if an elderly relative of yours stumbled, fell against the wall which fell on them, fracturing their hip, causing their death you would feel the same, its the relatives fault as they "couldn't control themselves"...

    The OP has a duty of care, simple.
  • Agreed - about the "duty of care".

    I've modified things - in both last house and current house - because someone being careless "might" have injured themselves. No point in arguing that they should have been more careful - just get things sorted because people often aren't careful.

    If the wall was built and then had the railings attached to the pillars afterwards when the mortar was still green there is a very good chance that this could off broken the mortar bond in a facing brick column where the railings where attached using a good hammer drill. Up to you but if i was rebuilding this it would be with 9x17 concrete blocks built on there flat, these would give a lot more strength than a hollow brick built pillar of similar dimensions.
