    Thanks All,

I wrote to the Highway Admin of the borough about the TTO asking "I would like to know when this Temp Traffic Order will be lifted?" and got the following response.

Please see reply below from the traffic section, I hope this answers your query, if not please contact us again.

Although the construction works have been completed for the Hawkswood Centre site, for which this temporary TMO relates to, we have been informed that the demolition works phase for an old building on the site are now being carried out which require the temporary restriction to be in place. The restrictions will therefore be removed from site as soon as we have received confirmation that these demolition works have been completed.

    Thanks

    Should I now just pay?

Hmm. Being pedantic, surely by their own admission they are confirming that the works relating to the TMO have been completed. Therefore the demolition works are a separate 'incident' which requires a new TMO?

Have you appealed the ticket as I suggested in post #8?

  • Yes, I have applied again asking for a response on the question I asked but no reply yet.

I have also replied to the email from the Highway Admin, asking for details on when the demolition work started, when it will end and was there any announcement done for this demolition work.

Awaiting their response. I have until 23rd to pay the discounted rate.

I expect Tilt would agree with me - do not pay. Are you on pepipoo getting advice too? There is no risk with Council PCNs, as long as you do not ignore them and carry on with each stage appeal then adjudication.

It is just that the discount would be lost but that's just a bribe not to appeal and would not be my concern, in your shoes. I would recommend taking that leap of faith - get pepipoo advice and you are likely to win. Council appeals are 'all or nothing' and almost everyone wins when they know how to appeal.

I agree with Tilt, the original TMO needed varying or a new one and I would argue you were entitled to rely upon the old TMO information communicated to locals. With no valid TMO, any lines on the road are just drawings because you can only contravene a TMO, not the lines themselves.

  • At pepipoo they recommended the following:

Sounds like work is still carrying on.
In which case order is solid and I'd grab the discount if still available

    So I am confused now.

Up to you then - I agree with Tilt and would argue you were entitled to rely upon the info communicated.

How important is the discount, would you rather fight?
