  • Still the original one. This is TNC just sending more "scary" (lol) letters even though the BPA are investigating breach of COP. I would make a counterclaim for DPA but I don't think this will get to court. Once resolved it will be something I will be considering, I've actually enjoyed playing their little games so far.

    I emailed the BPA again when I got that exact letter and told them will you also stop these clowns contacting me further. Lol

  • Hand written letter just received from Autosec, "we can confirm the above PCN has been cancelled"..


    Nothing from the BPA or DVLA....they better not think this is the end and the complaints can be dropped.

    Now it sounds like both of you have grounds to complain to the ICO about TNC and Autosec, about misuse of data in breaching the BPA CoP/KADOE rules.

    Get the ICO to agree and you then have solid evidence to sue Autosec for passing your VRN to TNC to look up, far too late, in an effort to circumvent the rules to pursue the keeper months later. And TNC are also liable for misusing the data and applying to the DVLA without reasonable cause, using (I think) the wrong form and the wrong company name and wrong excuse for getting data.

    You should be able to build a case to sue for data misuse under the DPA (breach of the Data Principles) but complain to the ICO first, showing your evidence.
