    I sent a stern email to the BPA also with all the evidence on 20th January copying in the DVLA not heard a dicky yet

    Funnily enough they replied today all parking charges cancelled

    Just seen on your thread Rich, well done. Will be happy to get pcn cancelled but I am more interested in taking these 2 companies on. They should not be allowed to carry on business in the way they do.
  • Had reply from BPA....I take it they are accepting that there was a breach of COP.


    Thank you for your email and for forwarding the information as attached.

    We will investigate complaints of alleged non-compliance with a point raised in the AOS Code of Practice and apply our internal investigations processes to request further information from the parking operator concerned. The BPA is not a regulator for the private parking profession but as a Membership Association it is a requirement of AOS membership that the Code of Practice be adhered to.

    If any non-compliance is found as part of the investigation process the operator will be required to deal with any issues raised and to provide satisfactory evidence of this having been done.

    In addition to the above we have a Sanctions Scheme that is applied to all operators within our membership and annual Audits are carried out to address any issues that may arise.

    Please be advised that as we are a membership association and not a regulatory body, we have no authority to cancel parking charges, intervene in the parking charge appeals procedure (either with the parking operator or POPLA) or to recall parking charge notices referred to debt collection agencies. We can, however, assist in the rectification of a breach of a point raised in the BPA AOS Code of Practice.

    In this instance we have sent the details of your complaint to the parking operator, please note we allow up to 14 days for a response. Thank you for your patience whilst this matter is being looked into.

    So how come they have just cancelled 4 that I recieved just a few days ago ?

    the BPA will not have cancelled them

    but the fact they are investigating has put pressure on the idiots chasing the alleged debt or debts , so either the PPC, or the DCA , or both , so it became a hot potato that they dropped , especially the DCA as they want to retain their membership and access

    so if the PPC had to "go it alone" , to court , they would have to file court claims , pay fees , all sorts in order to try and get paid , so like the lottery , you have to pay and be in it , to win it (or to lose)

    they got rumbled, so they chickened out
  • Another TNC letter for the pile and just shows tactics they get up to.


    "NOTICE OF INTENTION TO ADVISE CLIENT TO ISSUE SUMMONS"


    blah blah blah etc. unless settlement received by this office within 7 days of the date hereon....lol


    Letter date 31/01/17. 4days to walk to post box. envelope date stamp 03/02/17, received 06/02/17. Oh dear to late , already 7 days.


    So can look forward to


    " court order against earnings or
    Seize certain assets or
    court order for financial examination or
    Action to be declared bankrupt."



    You can understand how folk bottle it and just pay up.

    Is this a new PCN or a continuation of the existing one? Either way, more complaints should be made to the BPA and DVLA, especially if it relates to already cancelled PCNs.

    Are you up for a DPA counterclaim? I am sure help will be available if you are.
