    Make sure that you copy Morrisons in on this as well, ava if I was in your situation, I would also pop down to the Morrison's in question, if possible with a print out of the above and read it out, then hand it to the manager, and ask for your £475 in order to settle the issue there and then.
    It may not get far at local level, but it could well cause a stink, and may make the local staff question the ppc issue

    Why are you even considering paying? If they have messed things up as much as it appears, fight this and they could be paying you for their incompetence.

    Just to give you all an update - i've finally heard back from parking eye today via email and they've basically said that they've now agreed to cancel the original charge, apologised for the error on the claim form but have stated that they do not regard it as a data breach as the persons name was not used and therefore they will not be offering any compensation to me and will defend any claim should i wish to take it further.
    I should also tell you that i recieved an email back from SRA (none of the others i emailed) saying thanks for letting them know but they've decided not to take any action in this case and that they keep a record of all complaints should any follow up action be taken in future.
    All in all i'm just so happy that this has finally been cancelled and i dont have to worry about it ever again and hopefully never have to have any dealings with these scumbags in the future. Thankyou so so much to Coupon Mad and all you others who gave support and advice. I hope that this thread helps someone else who may be unfortunate enough to go through something similar. :)

    you will have to mull over the facts to see if you have a case under the DPA , but as its cancelled its all down to you now

    just be careful when parking on any private land from now on , because PE infest a lot of car parks , plus the dozens of other private parking companies as well, to trap the unwary

    I consider that a Court claim win, as good as any other we see. Nice one, you got lucky there with their data breach (of course it was)!

    What claim form is that? This isn't a claim form - which must be sealed (a formal stamp - stamped at individual courts but printed onto the form from MCOL, Northampton). This form has originated direct from PE themselves using the MCOL template - which begs all sorts of other questions.

    On the facts the OP has provided there would seem to have been a breach of at least 2 of the 8 data protection principles (1 and 4) but of course PE wouldn't consider there has been a breach. Turkeys don't vote for Christmas. The fact that you personal data has not be disclosed is somewhat irrelevant. The way in which it has been handled overall demonstrates that the data was still mishandled.

    I hope that you have complained formally to the ICO. If they choose to investigate and find that PE breached the DP principles then that is likely to assist in suing them for any DPA breach.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    You have the opportunity here, should you so wish, to cost PE several hundred pounds. Their incompetence astounds, and if they are using false documentation, as it appears they are, they could be in the deepest of deep doo doo.
