    I'm surprised that the police are interested. Isn't it private land? Most car parks are deemed as such

    "The definition of a road in England and Wales is ‘any highway and any other road to which the public has access and includes bridges over which a road passes’ (RTA 1988 sect 192(1)).     No need to get hung up on what a road is as the road traffic act was change from a motor vehicle on a road to a mechanically propelled vehicle in a public place as far as accidents are concerned.

    Even on a public road the police aren't interested so I agree with you that it's strange. We were hit by another car when parked, it didn't stop but we got reg. Reported to police but all they did was pass on keeper details no other action. It was up to us to report to insurance
    Remember the saying: if it looks too good to be true it almost certainly is.

    The quoted text is from the gov.uk current webpage (last updated 05/12/16) and *is relevant* because I was responding to someone who suggested accidents in car parks were considered to be non-reportable because they happen on private land.

    If you feel the text is incorrect then take it up with Department for Transport.

    The relevant part is public place not road.
  • Your wife's car was moving, she stop but it actually means stop and exchange details. As that wasn't done she had a duty to report it.

    No one can say whether or not she should have been aware of the damage as we don't know how bad it was. I do know that BTP do prosecute for such matters on station car parks.

    The BTP officer that come to our house and took us through the options suggested that its on a case by case basis and anything is possilbe in terms of prosecution, guess it's like flipping the coin in matter such as this. I have to trust that who ever looks over the case and is the deciding body in this case makes the decision based on some common sense and doesnt proceed to prosecution. But I agree, they are within their full right to do so - just hope they don't want too.

    If you are not claiming for any damage to your own vehicle this will cause you nothing. Had a similar situation with my brother this time last year when he hit a parked car. Ended up going through his own insurance and it cost him nothing.
    You have to report it to your insurance anyway regardless so might as well get them to fix it.
