Ignored pcn - misadvised - now received wright hassall letter

Please could I get some assistance as soon as possible, I am desperate for some help with this matter.

I received a PCN on 17th August 2016 when my car was situated on A Private Car Park

I say “situated” as on that day I had broken down on my way back from Sheffield at around 2pm where I had been on a training course for work. I was on the side of the M1 for a number of hours until I was picked up by a partnering company of Green Flag – Mansfield Recovery.

My car was transported from there to the above car park in and left there as it was now 9pm and the garage that would repair my car, which is directly adjacent to the above car park was closed and the owner was going to push my car round to his garage in the morning of the 18th August (CAR WAS UNDRIVEABLE)

When my car was dropped there by Mansfield Auto, a ticket was placed in the window of the car to cover for “parking costs” until 10pm when the car park was closed ( i have a photo of ticket ) I also placed a handwritten notice in the car window stating that the car had broken down and was property of the neighbouring garage for repair purposes” (I have a phot of the sign in the window)

The car park opened again at 7am and I went down at 07.30 to again put a car parking ticket in the window, to cover until the garage owner had time to push it round into the driveway of his garage.

When I got there the attendant had completely ignored my handwritten notice and had ticketed me for £100.

On advice of different people I ignored this as it stated that because it was private land – it was unenforceable.

This was against my better judgement and I now find myself with a letter from a solicitor Wright Hassall asking for £280 !!

Please can you help me as I cannot face the prospect of having a CCJ – I look forward to hearing from you

    Which PPC issued the ticket in the first place?

    Other than the windscreen ticket, have you had any other paperwork through the post, ginned up to look like a proper Penalty Charge Notice? Maybe called a 'Parking Charge Notice' or a 'Notice to Keeper'?

    What does the Wright Hassel letter actually say?

    Have you spoken to or written to *ANYONE* about this?

    Have you admitted who the 'driver' was?

    You only get a CCJ registered against you if this goes to court and you lose (or you ignore the court and end up with a CCJ by default), in either case the CCJ won't have any impact on you unless you fail to pay the amount ordered in full within 30 days of the CCJ


    Read up in the newbies faq thread on how to deal with court claims, so you are prepared should it come to that

    The PCN was issued by Elite Management .

    The Wright Hassall letter said that they have been instructed by ZZPS on behalf of Elite Management in connection with the recovery of debt following the failure to repay the PARKING CHARGE NOTICE.

    I have not spoken to anyone or been in contact with Elite abut the PCN

    So - just to be clear - other than the windscreen ticket on the car which was there on the 18th, you've had NO OTHER PAPERWORK AT ALL through your door (at the address the vehicle is registered on your V5c) until the letter from WH, which presumably is them coming after you as the Registered Keeper?

    You will not get a CCJ by defending a claim if one arrives. What you have said above would almost certainly stand up in court and even if you lost you'd have NO CCJ and would pay maybe £150, not over £200 (they've inflated it). And we say you would much more likely win, and in any case Elite are not known as being litigious.

    If the WH letter talks about you paying ZZPS (debt collector) then it is NOT a real pre-court letter. It's just another debt letter if payment is to a debt collector.

    Do a Google search 'BMPA insight Wright Hassall'.

    i then received the letter from WH.
