A few years ago I had financial difficulties and went on a DMP.
So I had to make sure my bank account was not in debt so I could close it.
So I posted a letter in my branches letter box informing them the account was to be closed.
Then I went away for work not realising that that night some one with a JCB tried to remove their cash machine.
So the branch was damaged and closed.
A few weeks/month later I received my letter back with a covering letter stating that they could not close my account as now it is in debt only because they took out my loans even after Step change and I had informed them that any future payments would of come from my DMP.
I have paid off the balance once which then I thought they had closed the account. but they have been charging me account charges which has been sold to Idem servicing.
So I don't know if the original account is still open they just tell me its in the hands of Idem.
My question is should the bank of closed the account in the beginning when the letter was on their premises have they been unfair.
Thank you for reading.

Midland Bank haven't existed as a separate brand since 1999, so when did all this happen?

They really haven't, for the reason TadleyBaggie has given. I'm treating this as a wind up until the OP starts to make more sense.
  • I still call 'HSBC' Midland and Santander 'Abbey National' in conversation but I'm old fashioned like that. It confuses the youth in the office.

The spelling is perfect, apart from the jaw-dropping 'of' instead of 'have' in should midland bank of closed the account ! OP if you want help, then I suggest you edit it because it's devoid of all punctuation apart from full stops. The typo is easily corrected: edit > go advanced.
  • I think it will be down to when the bank were actually advised of the DMP.
(Not when you filled in the forms but the formal date of advise)
If the loan repayment went through prior to the notice then the account is overdrawn and cannot be closed (unless they decide to write it off).
If it went through after you may have a case but you would need to go through HSBC 's complaints procedure.
  • Thank you for the replies. I have edited the name of the bank . Sorry it had been a long day.
The bank was aware about step change before I tried to close the account. The ideal solution would of been for me to have gone to the branch my self and closed the account but due to work I couldn't do it.
This was back in 2005 and I thought the money owed had been paid off but the account was never closed and I didn't find out until last year that they sold x amount of over draft and account charges to idem this was around £350. Which in a year of paying £20 a month has only cleared £50 off the amount due to consolidated payents ?.I have emailed them and tried to phone them today but no luck. My bank tells me that the debt is with idem but won't give me a answer on if the account is still open.
Because this has been going on so long I don't know what my options are. Hence asking if a letter is in a banks premises then should they honor the request on that day.
  • The original account debt was paid via step change. So I suppose I should of tried to close the account again at that point. At the time they had stopped statements and I think they may of changed the account number as it was with their recoverys dept.
Over the weekend I'm going to go through what letters I have kept.
