My friend has got a PCN from Devere. Please advise what she should do ?

Hi all,

My friend got a PCN from Devere, Castlepoint.

She is a diabetic and was having a hypo. She stupidly parked in a disabled bay (I know that she can do that under the Equality Act 2010 ) to get some sweets from M&S. She was there for a few mins until she felt her hypo getting better. She would have advised a parking attendant but there was none around. Whilst in M&S, she got a PCN that stipulated a time gap of 10mins.

She paid for the sweets with cash and has not kept the receipt.

I know that Devere like to take people to court and there is little value in using IAS to appeal as they will not uphold in her favour.

Could someone please help and advise what to do next.

    Devere like to take people to HIS LOCAL court.

    perhaps a friendly relative in the bleak northwest could foward mail on? , perhaps an appeal to devere from the cold north before he accesses the DVLA database?

    he will try to get this in his local court , where his drinking buddy the judge will assist him , annoy the guy , see if he fancies a 600 mile round trip , you can always pull out at the last minute

    it is always worth complaining to the landholder , and try mentioning the EA2010, that may help too

    from memory his contact is with the car park owner , do M+S own it?

    stating your disappointment to M+S , plus comments on any web pages might reduce your anger , but in this context I think Ms Fenella LANDAU is bullet proof in this area

  • She has now sent a cheque to them via post. She has got a proof of posting.

    I did not see any chance of winning this one after your posts.

    She will check with her bank to make sure the cheque has been honoured.

    Oh well never mind.

    NO I implied that you needed to be as clever as he is , challenge him , make him work for his money , make him pay for an appeal , cut his trash paperwoek up and ridicule him

    I implied that if it got to HIS local court , for some reason every judge agree with him , but not other PPCs (funny that)

  • So you are saying she should pay £100 instead of £60 by raising an appeal, which she would lose as/when it went to court.

    I do not understand the logic.

    no I,m saying you should have fought it and paid NOTHING N, its only the meek that end up in his home court , he won,t win anywhere else ,#
