It will still be difficult and costly for them to try anything up here. The fact that they have quoted a law that doesn't apply up here isn't in their favour either.
Herzlos, I would disagree with using POPLA for paranoid reasons, I. E. by using POPLA it could be argued that the OP has agreed to let English courts have jurisdiction.0 -

POPLA has nothing to do with the courts, and they can't expect the lay man to know that POPLA has no jurisdiction in this case; because it was offered.0 -

I agree it has nothing to do with the courts. However, as it was established as a direct result of an English law, accepting POPLA's authority can be viewed as acceptance of English law overruling Scots law, and thereby muddying the waters.0 -
Also, we had a scared OP from NI here who had a PCN for a parking event in Wales. She appealed to POPLA because it was offered and we expected her to win, but she lost and felt very much on the back foot. I am not sure if she held her nerve and didn't pay...
With hindsight, I feel we should tell people in this position (people living in NI or Scotland) not to try POPLA unless they have a slam-dunk, nailed-on winning point.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
