BW Legal & Excel utter farce!

Having read the Newbies posts and links and spent hours trying to sort out a disputed PCN Notice to Keeper with Excel (and now BW Legal) from August 2015, I'm utterly perplexed with what to do next

At the time I was unsuccessful in writing to Excel to explain I am the RK but was not the driver. I then requested a POPLA code but have since learned they don't use POPLA :mad: I moved house 5 months after the alleged incident and wrongly assumed the matter was closed.

Fast forward 9 months to this November and the PCN is now sent to my new address! So I respond again within 16 days saying I dispute the claim, yet the reply I received on Christmas Eve says "A COUNTY COURT JUDGMENT HAS BEEN ENTERED AGAINST YOU" (their capitals, not mine) on 14th SEPTEMBER (my capitals) - how did this happen? Time machine?!

For anyone who is interested in more details, I have spoken with GMPF who own the land and GVA who manage the land and neither will cancel the ticket.

Is there anything else I can do or is it too late? Please help!

ok , do you have mail redirect or contact with the new owner? , and the letter in november was it sent to your new address or fowardced

Thanks for your reply Pappa Golf, I'm really struggling with trying to make sense of all this. Only had mail redirect until May 2016 and no contact with new owner of previous house (rented). The new letter in November has my new address on it...

Is there any point continuing to dispute this revived PCN? Any idea why I would have received it after an apparent CCJ? Pure incompetence?!

maybe the letter was a mistake , suposed to be for someone else , check noddle or clearscore (both free) , IF there is a CCJ you need to work towards a setaside , but you have limited time once you know about it (or admit you know) , check credit score and report back

are you saying that a ccj has been entered on your credit file?

Yes! It's on my credit file which was previously excellent and it wasn't even my fault

very probably your fault by not informing them of a change of address , they are only allowed to ask the DVLA once , you need to apply for a set aside , and ask for copies of all caurt papers sent to you ,

a CCJ entered on 14th sept would have been thru a non court appearance on approx 14th aug , court papers would have been issued july , and prior to that you would have had numerous debt collectors and a final notice before action several weeks before commencing court

we are back in june now , so what about the plethera debt collection letters upto that point?

you need to see sight (and address) on the court papers

I meant the PCN wasn't my fault as i wasn't the driver, not changing my address was ignorance on my part.
