Enforcement Ltd lied on their POPLA appeal rebuttal

    I just came off the phone with the general manger of the gym and got the usual "we have nothing to do with this story", even with using int info from Half_way,

    Ask the Gym manager if the car parking company are there because the Gym has instructed them to manage their car park.
    There is slight a chance that the Gym may be a tenant, and the landlord has imposed the parking company on the Gym.
    However if the Gym has taken on the parking company them its everything to do with the Gym.
    If the manager has lied to you then you may need to take some action against the Gym

    I talked to the gym manager and even though he started off saying he had nothing to do with the company, he eventually admitted they do contract the company but apparently they lease the land from the district council. However they were rude and unprofessional so I don't really believe them.

    op - Don't think we fail to understand how you feel, but these POPLA appeals deal only in FACT, at times before inexperienced eyes.
    Before a Judge, PROBABILITY plays in, but not at this stage.

    Phone NO-ONE related to your scam parking event ''invoice.''

    Do everything in writing, creating a dated paper trail - in this case, cc the gym manager, the landowner.

    Did you have contemporaneous pics of the ooo machine?
    Can you check again today?

    Keep screenshots and/or Proof of Posting.
    Choose between snail mail and email submissions. Each has supporters here:-)

    Send NOTHING Recorded Delivery.

    Post drafts here for a critique first.

    Errors like 'outlying'[for 'outlining'], lumpy grammar and florid adjectives/adverbs do not help popla appeals.

    Thanks for your help, ampersand.
    I will make sure to use email in any correspondence from now on.
    Unfortunately I did not have my phone on me, so could not take photographic evidence of the machine. However, I did enter a witness statement backing up my claim into my appeal.
    When I revisited, on the day of my PCN, the machine had already been repaired.
    I am going to email one of the gyms executives today and will post a draft here first.
    At the moment I feel that it would be a wieght off my shoulders to just pay the PCN if I do lose at POPLa.

    If you do this properly you won't lose at PoPLA. The PoPLA decision is not binding on the motorist so they can ignore it.

    If you pay when you don't need to, you will be funding the scammers to continue their disgraceful behaviour. To be blunt, if you pay you will become part of the problem. Everyone here has given up their own time to help you for free. It will be a kick in the teeth to all of us who contribute if you pay unless a judge has ordered it.

    Have you left negative feed back on the gym's website or social media yet in order to warn other gym user's about this parking scam?

    Sorry, but PPC's just love people like you it's what keeps them going, and makes their bullying tactics worthwhile as they laugh all the way to the bank!

    You should be offloading that pressure onto the shoulders of the Gym management

    I don't think that it matters - I thought that the ppc wasn't disputing that it was inoperable, but that there was another machine you could have used ?

    This is clearly the 'evidence' that you need to rebut - ie photos of the site showing the single ticket machine. Count and photo how many signs are there as well - the ppc may have 'embroidered' the number in their evidence to Popla.

    Fruitcake. I understand where you're coming from and very thankful for everyone's help. However I don't have the time, money or experience to take the PCC to court. Trust me the last thing I want to do is give these scumbags any money! I am willing to use any of my free time to fight them and make a stand.

    I have contacted our local press to see if they would be interested in the story and left feedback on social media. Furthermore I will contacting the marketing executive of the company that owns the gym directly.

    If I do lose my appeal is there any advice you can give me?

    Of course. People do sometimes lose at POPLA and if you search this forum for just the two words: 'lost POPLA' you will find some recent cases. People are told to ignore the PPC and only take seriously a court claim. Trouble is, CEL do sue. The good news is, their cases are defendable and we have not yet seen one go to a hearing, let alone lost.

    I don't understand why you haven't (seemingly) taken your chance to rebut the evidence pack - you only have six days to comment on the POPLA portal so why are you telling us about the lies and not telling POPLA?

    Sorry if you already have, but I've read this thread and it seems you are on a tangent instead of commenting on the evidence. That's the stage you are at.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
