Hi folks,
I'm looking for advice with a recent POPLA appeal. I appealed on the basis that the sole parking machine at the location that I parked was out of order.
The ticket was issued using ANPR cameras on site.
I recently received a response from the operator and have submitted my comments outlying inaccuracies and blatant lies in their response.
One such inaccuracy is that the picture evidence they used of signage on the site was incorrect. Secondly they state "there are 2 payment machines in the car park", this is blatantly untrue. Furthermore they state that I appealed on the basis that I left the car park after finding the machine was not working, which I never stated nor referred to in my appeal.
I am trying to figure out my options going forward, the first being whether or not to ring the gym manager, the owner of the site and explain the unprofessionalism of their parking operator. Should I aslo ring POPLA and reaffirm these inaccuracies?
Thank you so much for all your help
Connor

a lot could depend on the company involved and if they are a company that starts court action , now they have lied to POPLa , you know the type of people you are dealing with , and could (with the correct paperwork) win them in court

ringing or better still going to see the gym in question would be good , as would contacting the landowner , who indeed may find his taking were down that day due to faulty machinery

who was the PPC in this case?

Ringing POPLa wont get you anywhere, however you should contact the Gym manager and inform him/her that you expect them to cancel the parking charge with immediate effect.
if they trot out the nothing to do with us line then you need to remind them that they are responsible for the actions of their agents, and you do not appreciate having your time wasted by their lack of due diligence in appointing a predatory parking company that employs aggressive business practices in pursuing patrons of the Gym and you will be looking for some recompose for your wasted time as a result of the Gyms agents actions ( the parking company) , which the Gym as principal is liable for

Is it Parking Enforcement & Security Services? It's the only BPA member I can find with a similar name.

The name they have at the top of their PCN's is parking enforcement ltd. On their rebuttal to my appeal the name is listed as civil enforcement limited.
I just came off the phone with the general manger of the gym and got the usual "we have nothing to do with this story", even with using int info from Half_way,

If the POPLA case is ongoing, contact them via the web site to explain the false evidence.

If it is finished, complain to POPLA and ISPA and BPA that false evidence was supplied.

It's time to leave negative feedback on the gym website/social media warning people that the parking company employed there is telling lies and the gym won't help. Local and national press might also be interested.

Then, find another gym that doesn't have parking scammers.
