HELP! Legal proceedings against me for someone else's PCN

    I suggest you back the email up with a letter. Keep a copy, send it first class from a Post Office counter and obtain a free proof of posting. Also take a screenshot of the email.

    You should also complain to your MP and Mrs May, as well as trading standards and the SRA about this scam and breach of DPA.

    They are well known for being incompetent and you will see very clearly that they are incompetent

    Hope you do realise hoohoo is serious that you can claim £500 or more for this, in court if necessary? If they send you a claim before you can file a claim yourself, we'll help you to word a counter-claim.

    Personally I would include the owners to Robin Hood Airport in the LBC. That should focus their minds to pay you £500 and leave you alone.

  • Last year I told them this and spoke to the DVLA who said they would check the details and I should just ignore the letter.
    Did you ever get a conclusion on how VCS/BWL got your address? Did the DVLA get back to you?

    As well as the DPA approach, it may be worth the £10 to submit a Subject Access Request to find out exactly where they got your name and address from.

    Yep I do, I've sent that letter as advised and am more than prepared to go to court over this! I have also sent a report to the SRA detailing the principles of theirs which BW Legal has breached time and time again.

    Thank you, I appreciate the offer for help. I will update this thread once I've received a response from either BW or the parking company, if they do not wish to cooperate with my request for compensation- whichI doubt they will- then I will see this through to court! The letter I received today actually says that they will be instigating court proceedings against me if I do not pay by Jan 16th so we'll see.

    Unfortunately DVLA never bothered to get back to me, I am going to send them another letter now though. Thanks for the advice, I will send one of those requests because I do want to know!

    I have yet to receive a response to any of the emails I sent however I do have a query; I spoke about this being my issue to simplify matters however the letters etc have actually all been addressed to my father. If this went to court is there any way I could attend for him because he simply wouldn't be up for it?

    Thanks Peter for your prompt response, I am sending them a very stern email right now reiterating this is not my vehicle, never driven by me, never received a PCN and never been to the airport. I am also forwarding them my email from back in April in which I told them I deem these letters to be harassment.

    Unfortunately they have provided no evidence of the contravention, they only included the details which allow me to go and pay the amount on the law firms website.

    Personally, LeedsGirl, I'd go for a traditional letter - emails can be claimed as "lost" or "never received" by these scumpanies - a letter is considered served 2 working days after posting by a court.

    If you send a letter, DO NOT send it signed for and DO get a free Certificate of Posting from your post office.
