Faulty tablet - Argos

Purchased a tablet from Argos in February. A couple of weeks ago it stopped charging. Took it back to Argos and they sent it off to Samsung for repair. The tablet came back a week ago and has been fine until we put it on charge this morning and it only charged 19% in 3 hours. When we switched it on there is now an issue with the screen with lines down either side and it flickers. I want it replacing instead of being repaired again, I find it strange that this has now happened just after it has been fixed. What are my rights to request an exchange?

  • You can ask but they may refuse it which they are allowed to do if the cost of a particular remedy is disproportionate for them. If they cant/wont exchange though you can still seek a different remedy


    - keep the item accepting the fault but negotiate a price reduction to reflect the reduced value
    - reject the item for a refund - may be partial refund to reflect the usage you have had to date


    You don't necessarily have to give them more than 1 change to repair/replace though so now they've had one chance and it is still faulty, you could just move to either of the above two options immediately if you wish.

    Argos definitely haven't changed their ways then. They did this to me over a faulty camcorder many years ago and in the end I just gave up trying.

    Although I think it's after two or three repairs that you are entitled to a refund or replacement because if it's still in warranty then they have to do something. If not, then threaten them with trading standards

    Law changed for contracts entered into on or after 1st October 2015. It used to be there was no limit - you'd basically have to argue the length of time/number of repairs had been unreasonable. Now, if the goods do not conform, they have 1 chance to repair OR replace. If after 1 attempt the goods still do not conform, you can allow them further attempts but you have the right to insist on a refund instead.


    However, Argos could be awkward and argue that the first repair was carried out under warranty and/or ask OP to prove the fault is inherent in nature. So I'd advise OP to ask for a replacement first and see what their initial stance is. Or perhaps if they say they'll only repair, OP could also (preferably in a way they can prove, by email or live chat screenshot/transcript perhaps) agree to the repair but on the condition that if it fails again, it will be a replacement or refund and not another repair.

    Do trading standards bother getting involved ?

    OP, as you have had ten months of use they can offer a working refurbished tablet of the same model as a like for like replacement. As said previously if they offer a refund they can reduce the amount to take into account the use you have had.

    Not in instances like this.
    The "threat" of Trading Standards only works if the company concerned are actually trading illegally in some manner...

    Presumably you picked it up just before Christmas. Given the holiday period since then, if you haven't taken it back yet, I'd be tempted to return it to store and say it's not worked properly since it arrived back.

    Since it's only been back a week, how will this result in the OP getting a replacement rather than another repair or part refund?

    OP think carefully about what you want if you go for a replacment you will have less than 2 months warrenty left on it as the warrenty will be taken fron the original purchase in Feb.
