UKPC/SCS LAW dragging me to court for parking and leaving site
hycene
Hi guys, I got a court letter from SCS law representing UKPC.
The charge is that the driver of the car breached contract by parking n leaving site, even though the driver used the ALDI STORE, and parked there for less than 20 minutes in a 2 hrs free car park (Vastern court Reading).
Parking is in a retail centre which is 2 hours free, displayed on sign, with parking conditions buried in small print.
They're claiming £160 for leaving site in a free car park??
I have acknowledged received of court papers n I'm looking for extra help preparing my defence.

Have you looked through the Newbies thread here, specially posts #1 to #5?
Did they send you a NTK?
Do you still have receipts from your Aldi visit? If not, bank/credit card statements may be usable instead - they would still show a purchase was made, but not the itemised detail.
A rough timeline of events may also help.
When you acknowledged, did you say you'd be defending? That gives you 28 days instead of 14 to put your paperwork together.
Have you complained to Aldi as well?
Is this another one of their stores where you're supposed to enter your registration number while in there or the checkout operator asks you for it?0 -
Yes I got NKT, but ignored it especially as I knew about their reputation.
I read the newbies bf deciding to fight, and yes I'm defending all claims.
I did write to ALDI CEO, and got a reply immediately from their parking mgt saying they can't help because they've no relationship with UKPC and that the store can help with receipts, but I've checked my bank statements n I can see I used my card.0 -
Aldi and UKPC are not the usual combination, sounds like a retail park with multiple stores.
Not many 'left site' cases have been to court, and fewer since this:

That hasn't been the advice given to people in England and Wales for 4 years now, except for very specific circumstances or people in Scotland and Northern Ireland.0 -
I very much doubt if this ever got to court. Leaving site is very difficult to win. If the parking weasel saw you leave the site, why did he not attempt to warn you of the financial consequences of doing so. He is required by law to mitigate his employer's losses.
You could call him as a witness and ask what instructions he had received from his employer.
Besides, it may be an unreasonable contractual term. If the wind blows a fifty pond note that you have in your hand off the site, are you not allowed to chase it?You never know how far you can go until you go too far.0 -

So, what you waiting for if the store says they can help ??
No receipt, no problem, copy of the card statement with all other transactions blocked out ....... that is your proof.
PLUS. you put UKPC and SCS law TO STRICT PROOF with pictures of you leaving the car park, well knowing that UKPC fake pictures.
The courts know already that UKPC fake pictures0 -
