My ex stole my identity for a credit card!

  • What an awful situation! I do hope you manage to resolve it soon, it is so unjust.

    Are you by any chance able to prove you were elsewhere the week all the in-person transactions were made? If it was a particular week I wonder if you were away at the time? If you had debit card transactions/other in-person transactions that could place you elsewhere?

    Also, could you contact the local takeaway places and tell them you need an order receipt matching the orders "you" placed? I doubt hed be clever enough to remember he was committing fraud when he ordered his vindaloo, so if you can get a receipt matching the credit card transaction but with the order placed in his name, then all of that plus an email copy might be helpful if you escalate to capital one.

    If none of that works, definitely the ombudsman. Everyone who has a partner knows their bloody DOB and address and today it would be so easy with those online check boxes, so if capital one don't want to help, then tell them you intend to raise it with the ombudsman and see what they have to say to that! With all the email evidence, I would be very surprised if they didn't side with you.

    I would be asking Capital One to at least freeze the interest so that this debt can't get bigger.

    If the debt isn't the OP's then I would completely ignore the interest issue :o

    OP escalate it using their complaints process - stick to your guns, and chase up the police regarding this. If Capital One has a twitter or FB page then post on there too - that can often get quick responses!

    It sounds like you have plenty of evidence in email etc to back up that he did it and CapOne might re-evaluate when or if he gets charged by the police for it.

    Good luck and avoid talking to him if at all possible.

    Don't take No for an answer, kick up enough fuss and they will start taking you seriously.

    Remember, these companies hate bad press !!!

    It sounds like the bank has misconstrued this: a couple take out a credit card together, then they split up, and one complains to the bank that the other has done all of the spending and she now wants to be disassociated from it.

    But clearly from the OP's description that isn't what has happened this time. Let's hope someone in the complaints team has a better attention span and a bit more brain.

    Just a damage limitation suggestion. And if Cap 1 were to freeze the interest it would show they are acknowledging it's not a 'normal' debt

    Debatable - as the debt has defaulted due to non-payment it's likely interest would be frozen in any case, especially on request.

    I see your thinking :) but the fraud is the key point for the OP to stand firm on.
    You have just reminded me of a point though:

    OP if they have now turned DOWN your claim this was fraud, they should have no issue providing you with a detailed statement of locations and times of any transactions :)

    See if they have decided they can issue those to you, if not then you have another bow to your string with them in that they are accepting it's fraud potentially...

  • Hi again everyone,

    Thank you for all of your messages. I have a little bit of an update! The police called, and said that they are requesting information from Capital One and probably wouldn't call me again until the New Year. They also said that the emails I had sent them sort of helped as evidence, but he might deny them so they're more interested in what information he gave when setting up the credit card account.

    So I called Capital One as I'm now the one liable and asked for a breakdown of what was spent and which email address this card was linked to. They told me the exact times and amounts for each transaction - the flights, the pub and the Indian food. They couldn't tell me the email address over the phone, but will be sending me this information through the post. I wonder if it'll be the same one he normally uses - with his full name?!

    I then called the flight company to ask for information. They asked for the phone number given at the time of booking and I tried his mobile number - it worked! When I asked them to give me the email address linked to the flights, surprise surprise it was his primary email address which incorporates his full name. He uses this email for most things (including all of his emails to me) and I'm hoping this includes official bodies too (possibly CSA, etc - but I don't know).

    I will be contacting the Capital One complaints department today too. According to my credit report - when doing the quotation search, my ex gave the wrong year for my birthday! Then for the actual application gave them the correct one. I think this should have been a definite warning/sign that something wasn't right. Also, I keep receiving letters and calls from them about late payments, etc - which is just causing me so much stress. I don't think this should be happening while this case is in dispute.

    Thank you all again for your help, and I will keep you updated.

    If they keep sending correspondence asking for money etc, bombard them with complaints letters.

    Make enough fuss and they will do something about it.

  • Good news on the progress! Someone more qualified than me may be along to advise on the continued harassment over payments, but I believe it falls under the Financial Conduct Authority's Consumer Credit sourcebook as the following:

    "A firm must suspend any steps it takes or its agent takes in the recovery of a debt from a customer where the customer disputes the debt on valid grounds or what may be valid grounds." 7.14.1
