PCN from Parking Eye - Preston Parking PCN appeal turned down by PE

  • Thank you for all your help guys. The letters are ready to go either in PDF format via the online application, or we could print them out and send by Royal Mail "Signed by" service.

    2. If we use the inline service, there seems to be a series of boxes you tick. How do we ensure we get the correct boxe ticked without havig to add more than "See the attached letter"?

    3. Should we include the original appeal letter to ParkingEye?

    4. Should we include the scanned files that include copies of the tickets?

    It is an 11 page letter.

    This must have taken you a huge amount of time. If PE decide not to contest one or both of the appeals, (which they often so), you should surely be recompensed for your time.

    To that end, I should write to them warning them that if you win, or they do not submit any evidence, you will be invoicing them for your time at £19 an hour.

    They will almost certainly write back refusing to pay, but it clears the way for you to take them to court, if you are so inclined. It is more than possible that, if you issue a MCOL, they will then settle, as fighting it would cost them more.

    If it did get to court, you could allege that PE's behaviour was unreasonable in pursuing you for a very small amount, caused by circumstances entirely out of the driver's control, and/or a minor human error.
    You never know how far you can go until you go too far.

    Just wanted to post the decision by POPLA that we received earlier this evening. I say decision, but ParkingEye decided not to take things forward. The email from POPLA is given below with details redacted.

    A huge shout out to some excellent guidance from individuals who are knowledgeable and so responsive to questions or guidance being requested from them. Maybe the 11 pages were overkill but it worked with your help.

    To anyone thinking that these parking fines heavily favour the parking companies, do not be afraid to fight - with the right quality of help of course.

    The downside is that we still do not know exactly which part of our appeal caused PE to back down.

    Here's the email...

    Dear xxxx

    Thank you for submitting your parking charge Appeal to POPLA.

    An Appeal has been opened with the reference xxxx.

    Parking Eye Ltd have told us they do not wish to contest the Appeal. This means that your Appeal is successful and you do not need to pay the parking charge.
