Ok, my appeal is in. All I have had back is an acknowledgement they have received this. Should I have got a date back as well for when its supposed to be done by ?
Just wondering how long the process usually takes.0 -
Just checked my appeal on the Popla website. It says still waiting for "operator to provide information and evidence about your appeal".
Do they have a fixed amount of time to go back to Popla ?0 -
21 days (ish) but you will be sent a copy of any evidence as well.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Fixed that for you.0 -
Thanks for the replies. Of course they wont need to send me a copy of the evidence, as ECP will just roll over and admit defeat (wishful thinking ! ) :rotfl:0

Okay , so I have just had an email from ECP with 'further evidence' that they are supplying to POPLA. I thought it was actually from POPLA at first as they have sneakily sent it from an email address of popla@eurocarparks.com !
As its from them, there is no indication how long or what I need to do next. (I guess another ploy to just make me pay)
They have sent reams of photos of the signage, and stating laws that they say they have adhered to etc. which I will have a look at tonight.
The quick few points I noticed is that the land is actually owned by a mysterious ECP Holdings Ltd . So its not a retailer unfortunately.
They also make the point that the driver had 45 mins to pay , as that was the length of time he car was there. They haven't still provided any evidence of any payments for up to 7 minutes of my wife arriving on the car park.0 -

Look for things like the start and end date of the contract, and blurred or unclear signage evidence as well as what you said above.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Afternoon all. Friday at last eh !
I have read thru the final letter from ECP.
Their reply is mainly loads of photos of the signage at the car park, and where the signs are. You can tell that they obviously have to keep producing this due to the amount of photos that they have, which are from 2015, and they say nothing has changed since then. I don’t think there is any more leverage on that front. But I can post what photos they have sent on here if helpful ?
They have now named the landlord, and unfortunately its themselves. Well, its ECP Holdings to be exact. So unfortunately no chance of appealing to them for help.
The most obvious thing that I noticed was that they kept changing the name (and sex ! ) of the driver. I’m assuming they should use the phrase ‘driver’ as they don’t know who it was ? Anyway, in some places they actually use my name e.g “Mr Benn’s stay in the car park.”’ , then in other places they keep referring to ‘her’ e.g. “no ticket was purchased matching her vehicle registration “ and “has failed to enter in her full registration”
This made me think they have just copied and pasted details from another person’s ticket. I then read further down (and please let this be a winner) and they said “Euro Car Parks have given Ms **** the suitable grace period of 10 minutes and was issued a Parking Charge Notice “
“ The surname given is not ours ! The fact they have obviously been copying some data from another appeal, does that invalidate the whole lot as who knows what other ‘evidence’ is actually from another case ?

Your bullet point comments to POPLA need to point out their evidence comprises 2 year old photos and no proof that the signs are the same at all, that some are not damaged, missing altogether, obscured by foliage, weather-worn and unreadable, etc.The most obvious thing that I noticed was that they kept changing the name (and sex ! ) of the driver. You must point all this out to POPLA tonight, not us. Is the Portal still open for comments? If not, you will have to email your comments.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
