Be careful with your very last sentence. They have said YOU didn't read the signs, and you say you refute it. That implies you were there and read the signs.

Of course, you could have been an occupant of the car, but it would be better to say that the driver tried to read the signs but they were unclear for the reasons already given.

Thanks fruitcake . I will amend it accordingly.

So do you guys think we will get our appeal passed ?
Im still concerned that this will be classed under the mitigating circumstances bracket , and get rejected ?
If ECP had supplied payments from the time we entered the car park, then I think we would've had it.

Im just looking on the official POPLA website , and in their annual report 2016 , it shows that the stats show that its about 50/50 wether an appeal is upheld or not

Yes but we win 99% of the time. Honestly, submit that as a PDF under 'OTHER'.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks coupon. Sorry to be cautious.
So you are happy with what I have written ?

So can ECP go back to POPLA with more evidence , or does the case get dealt on what they have provided so far ? I ask that because of the fact they didn't submit any transactions at the point of entry .

When you say submit it, do you mean on the POPLA website

We do mean submit under 'OTHER' on the POPLA website, you upload your PDF appeal and a little 'bin' icon appears (the system is weird!).

Your POPLA appeal looks as good as we can suggest for a Euro Car Parks PCN. Yes they get to submit evidence and you will be sent a copy of that and given a few days (yes just days) to add comments, not new evidence, just comments on their evidence. They do not then get another bite.

Just a last question before I submit this, but my wife has parked there many times before (sometimes in this car) and always paid. Could we use that as evidence of previous payment. Or is it irrelevant

    Totally irrelevant imo.

Just going onto the Popla website . I thought this would be the easy step !
The 2nd stage asks you why your appealing. On the section ' i wasnt improperly parked' , it doesnt list 'meters werent working. It says 'Other ' at the bottom , (as mentioned by mr coupon-mad) but says if you select this " your less likely to be successful".
Blimey - even more scare mongering

    I'm Mrs Coupon-mad!

    OTHER only.
but says if you select this " your less likely to be successful".
We know - they lied - POPLA had this scaremongering on the website before this version of POPLA even went live!
