Faulty mobile - 6 months old - can I insist on replacement?

Bit more than a standard fault. The charger completely melted.
Phone still works but battery does not last anything like as long.
HTC support have advised they're taking this seriously and want to see the phone to investigate further. At one point they said I could have a replacement but now they are saying I have to send it back to them first for investigation and possible repair.
So I have do without phone. Can I insist on replacement or not?
Must admit considering the seriousness thought they'd be a bit more flexible.

Did you buy it direct from HTC or fro, a retailer?
How long exactly have you had the phone for, purchase date?0 -
Legally your rights are against the seller. Unless you bought it direct from HTC then your communications with HTC are solely in relation to whatever warranty they provide. As such they can have whatever (reasonable) terms they wish. If they want to investigate the issue before providing any form of remedy then they can do so.0

Under 6 months makes it easier as some retailers ask for independent reports to check for inherent faults after 6 months.
There are 3 remedies, repair, replace or refund. You can specify which you would prefer, however its down to the retailer to decide.0 -

As above, No. And as I said earlier, HTC have the right to investigate and prove the fault exists and was not user-caused.0
