SCS Sofa problems

I am seeking some advise.

I bought 2 sofas from SCS in March 2016. The cushions on both sofas have failed due to poor quality fibre cushions. SCS have sent out a technician who confirmed that the cushions were faulty and would need replacing. He suggested that when I was called by customer services I took up the offer of paying extra for replacement foam cushions instead of the fibre as the same thing would happen with the new fibre cushions.

I have been contacted by SCS customer care who offered the replacement fibre cushions or the foam cushions at additional cost. I have told them that I was not willing to pay for foam cushions as the fibre cushion are not fit for purpose. The assured me that the new fibre cushions would be to standard, but would need plumping on a daily basis.

What are my rights? Can I take them to small claims court or would I have to wait until the second set of fibre cushions fail?

    All fibre cushions need plumping on a daily basis, it is the reason I chose to pay extra for foam seat cushions on my sofa, I wish I'd also paid extra for foam backs as well, the fibre filled are not ruined but certainly if you forget to plump for a day or two they go flat and misshapen and need a good beating to get them plump again. It probably wouldn't take long for them to go completely flat if never plumped.

    If I were you I would just pay the extra now for the foam, if they are offering free replacement of the fibre cushions that is all you're entitled to and as long as they are cared for properly there is no reason for them to fail again but fibre will never be as supportive as foam nor last as long so you probably won't even have a valid claim if you wanted to take them to court.
  • The cushions have been plumped on a daily basis since we had the sofa. Currently this is being done hourly!! I was not offered the chance of a foam cushion when we bought the sofas so wasnt aware they were available.
  • They have done what they need to do - provide like for like replacement.

    If the 2nd set of cushions fail you need not give them another chance to repair or replacement and you could request a price reduction or to reject the product for a partial refund

    They may at some point offer a superior product at no cost but they aren't obliged to do so
