No I was not given one, theres been no response to anything I said in the letter, although my letter wasn't really an appeal it was more just disclaiming keepers liability.

I can't remember exactly what was said on the phone with it being so long ago, I wasn't clued up on how to go about it, and thought it was unreasonable of their £100 charge. Even so, if they had record of this, they wouldn't be requesting for the keeper to name the driver in their NTK letters. I made the phone call, however the cars registered in my dad’s name, and it was his mobile number they are calling now.

I did state in my letter to the issuing parking company that they were misusing my information obtained from the DVLA and passing it onto a third party without my consent since the NTK was issued too late to hold the keeper liable. I also stated any further communication from TNC would be considered as harassment and the police would be notified.

Another thing to note, the full PCN was £100 and not since gone up with admin costs from TNC. But when i go onto the company issuing the tickets website where you would usually pay the parking charge, I can see the pictures taken on the event date of the car and the balance still states the reduced rate initially offered to me on the phone for £40, what would happen if I were to just pay it, would the whole matter be settled? Or would TNC still chase addition costs.

The issuing of the ticket company is Autosec.

Hi, the word you need to think about is SCAM. It's what is happening to you

Autosec is a bit time parking company with no clout.
Because they cannot steal the money from you, they use another bit time company called TNC.

On the TNC website, they claim to their clients that it is "No Recovery - No Fee"

That is because they actually have no legal standing, unless they purchased the so called debt and then, Autosec are required to tell you and so do TNC.

There are very few debt collectors who will get involved in the scammers industry because they are on to a loser.
Clearly TNC DON'T HAVE A CLUE.

You ignore TNC who are powerless to do anything, All they can do is pass it back to Autosec.

If you hear further from Autosec please come back here.

And YES, no POPLA code must be reported to the BPA and as you are being harassed, a copy to the DVLA

however the cars registered in my dad’s name,
Right. So HE must respond, or you can respond but always in his name only.
The letters are being received in my dads name, I'm fighting the cause though as he's not clued up on the situation like I am...
Good, as long as you are responding 'as Dad'.

Email to BPA has been sent, I'll await their reply and post further updates on the situation and also if Autosec are to finally make contact.

    Thanks for all the advice!

The response that I received from BPA was that they didn't see a breach in their code of practice, and would expect the PCN to include an appeal process which is to be made by the driver. Also stating that under POFA it offers to name the driver and should the keeper not name the driver the keeper is liable.

I've also read the other thread, sending a request to the DVLA today also.

If the company is dissolved, what happens to its outstanding debt? I understand that TNC wouldn't have legal clout unless they purchase the debt from Autosec as stated by beamerguy?

As of yet, no communication has been made by Autosec.
