    I cannot see where the OP mentions Hire Purchase or PCP.

    He mentions contacting the finance co. a number times. I may have completely the wrong end of the stick but I think it's fairly safe to assume the car is therefore on a finance agreement, eg, PCP or HP.

    The third possibility is that it is a personal finance agreement. I.e a loan taken out with the finance company specifically to buy the car.

    But we don't know either way.

    Or conditional sale, or personal loan, etc.
  • Yes it is on a conditional sale agreement so I am not the owner of the vehicle until the final payment. And you are correct it is down to the finance company to reject the vehicle.
    My rights I am not so sure about, that's what I'm trying to figure out.
    CAB have said that as soon as I said to reject the car that should of been it regardless because of the 30days rule.
    And have put me onto the financial ombudsman.
    So I must have some sort of say/rights.
    But I guess in the end it's going to be down to whatever the finance company decide.

    Although a personal loan would mean the OP would actually have been the owner of the car.

    Well if the finance co. are not following your instructions then you will need to contact the FOS.
  • Hi Thanks for all the replies and sorry if I have not been clear
    I purchased the car on 2/11/16 from a dealer ,paid with virgin credit card I believe the car belongs to me as it was bough with credit card not HP or personal finance .so I would be the one to reject it .It says on main site that you have the same rights with credit supplier ie virgin as you do with the dealer,
    However virgin have claimed they are exempt from 2015 act which gives right to reject and are acting under section 75 of 1974 act ,so either I don't have same rights with dealer and virgin or virgin are not telling truth, They are currently asking for 4th time for more information despite asking them on 3 previous occasions if they needed any other information ..
