Consumer rights faulty used vehicle!!!

Hi, long story in a short space of time but on the 03/12/16 I purchased a used vehicle from a local dealership, all well and good untill the following weekend when it broke down with multiple warning lights on the motorway.
Contacted the dealership they said on the Monday they will collect and get a diagnostic check and we will go from there.
So they collect the car, and tell us they are taking it to a certain garage to find out what the fault is.
Gave them a call later that day and they say it's at the garage when they hear anything they will let us know.
Few more hours pass and didn't hear anything so just thought we'd give the garage a ring to see if they had found out what it was.
Garage say yes it's all been done it's got an injector fault, at this point I was really concerned as the car had only done 16k miles.
the more I thought about it the more unhappy with it I was so thought I'd play safe and call the finance company to see what my options were regarding rejecting the car.
They called it lodging a complaint and said it takes 5 working days to get assigned to a complaint handler, I left it with them that I am seriously considering rejecting the car as it's a pretty big fault for such a new car, and waited for the dealership to call and let me know about the results(even though I already knew).
So we get to Tuesday noon still nothing from dealership, my partner gave them a call and told them we will be rejecting the vehicle under the Consumer rights act as it's faulty and we would no longer trust the car, they replied that we cannot reject it as they have already booked it in for repair.
When I heard this (I was at work) I decided I would email the dealership and tell them we WILL be rejecting the car, we are unhappy with there communication, and have already contacted the finance company to start the procedure.
No reply
Over the next few days I kept calling the finance company to be updated with the complaint/rejection and kept being told we will get back to you by Friday.
Friday comes still nothing so I call them.
Finally get past the customer services to the complaints team,
Who informed me they will not be supporting me with my rejection claim as I have given the dealership the opportunity to repair the vehicle?
Arguing with them on the phone for 30mins about how I have gave them the opportunity, I called the finance company on the Monday, same day the car went in to be "diagnosed" and because it took them 5 days to process it and apparently the car has been repaired it can no longer be rejected.
I feel like I am being bullied into taking this car back.
Even today I have still heard nothing from the dealership.
I have also contacted the garage that "repaired" the car and they said it wasn't just 1 injector it was 3! And that the parts don't arrive untill monday at the earliest! Yet the finance company say the dealership have sent them documentation that the cars been repaired?
Has anyone had anything similar or any advice would be gratefully appreciated, I have contacted CAB, The financial ombudsman and trading standards but everyone has procedures and timescales for things and as time ticks away the dealership are just going to get away with repairing the car against my wishes by just ignoring me and getting it fixed.

  • So you don't want it repaired?
  • I Would like a car that i bought 6 days ago to not need repairing.
Its more of the fact that I informed them I will be rejecting the car, which they have completely ignored.

Just to clarify, the people who will actually be rejecting the car will be the finance co., as at the end of the day the car belongs to them. You need to work with them to get this done.

You also need to ensure that the dealer doesn't carry out the repair.
  • Yes i understand that they are the owners and need to reject the car, however for some reason they seem to be leaning towards the dealerships side.
I made it very clear to them they wont be loosing out on my custom as i will still be using the finance on a different vehicle i have just lost faith in this car.
The reason they are saying they cant support it at the moment is that I have apparently given the dealership the chance to repair the car, even though it hasn't been repaired.

When they have repaired it, it will no longer need repairing... Everybody's happy.
  • Good luck, at least at the moment it is off the road.

You are being unreasonable OP, you should give them the opportunity to repair the car if that doesn't work then you have a case.
  • The Consumer Rights Act is quite clear that you are entitled to a full refund if you are rejecting the good within 30 days.

As the fault arose within 30 days, you do not need to give the dealer a chance to repair the car.

For now, I would explain again to the finance company and the dealer in writing (by email or letter - not over the phone) that you are exercising your statutory right to reject the car and expect a full refund.
