Court Summon for parking ticket, advice

Hello

I have used the forums a number of times to get out of parking tickets through POPLA etc, but one ticket I had i missed the appeal stage so for the last 2 years have had a torrent of letters getting me to pay it.

This morning a County court summons landed on my door step in regard to the ticket.

Not sure what to do, can someone point me in the right direction, one of my freinds/family parked in a parking permit only space and now i am stuck with this mess!

Any advice on how to appeal it would be very helpful!

i did use the search but couldnt see any noob guides?

    Appeal? You're beyond that stage now, you have to defend this.

    Have you logged on to the MCOL site via your password on the court papers and acknowledged service? That will give you an additional 14 days on top to f the initial allocation of 14 days to prepare and submit your defence. Make sure you do not put anything in the defence box - your defence comes later.

    Who is the parking company?
    Are solicitors involved? If so, who are they?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Yes. It is just like a formal meeting, may be a largish court room though.

    No - you would be hugely disadvantaged not to appear in person. DO NOT fall for Gladstones' offer to have the case 'heard on the papers' (that letter comes next after you defend - you DO NOT want the case heard on the papers).

    But no Gladstones cases defended on this forum have actually proceeded to a hearing yet, AFAIK. So a claim defended does not mean a hearing WILL happen.

    To see how to write a Gladstones defence, search this forum for 'Gladstones defence roboclaims' or 'Gladstones defence incoherent' which finds loads of examples to copy from.

    You may as well go ahead and defend it like everyone else here! Show us your draft.

  • Ok I have notified my acknowledgement to defend in full via the MCOL website. So I will take a look at your examples of a defence, modify and repost up for you to take a look :) before I send it off to them.

    I am having trouble submitting my defence through MCOL and i my original letter date is the 8th Dec, i have acknowledged it so that gives me the 28 days, so now i am on a knife edge for submission and i cant get into my MCOL.

    What is the email address of Northhampton county court so i can email it across?

    I usually tell OPs to print it off (set out like bargepole advises in the NEWBIES thread link, i.e. Times New Roman font size 12, with headings and 1.5 line-spaced) and physically sign and date it.

    Then scan it in full and send that signed/dated defence scan as a PDF attachment to the email. Claim number correctly stated in the subject line and the word 'DEFENCE'.

    Belt & braces, then ring Northampton court on Friday & check they got it.
