Viagogo - Concert Tickets Purchase - Refund

Hi all

Earlier today I purchased four tickets to a concert next summer at Alexandra Palace through Viagogo as all the tickets had sold out within a minute of going on sale on Ticketmaster...

After purchasing I realised that the tickets were standing, panic had clearly impeded judgement somewhat.

I made this purchase on a credit card.

Where do I sit in regards to obtaining a refund?

After a quick search it seems that they have a policy of no refunds but surely purchasing over the internet and with a credit card gives the consumer some sort of protection? i.e. The Consumer Contracts Regulations and Section 75 of The Consumer Credit Card Act, would these offer me some sort of route to getting my money back?

I have emailed Viagogo to ask for a refund but would like to be armed with some sort of basic knowledge for when they do respond in case they take the no refunds line.

Thanks in advance for any knowledge/help you may be able to offer here.

  • The Consumer contract regulations do allow for a change of mind cancellation for most goods purchased at a distance but there are some exemptions to this right.
    One of the exemptions is:
    (h) the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities, if the contract provides for a specific date or period of performance.
    http://www.legislation.gov.uk/uksi/2013/3134/regulation/28/made
which covers event tickets such as the ones you purchased.

Because of this, Viagogo have the legal right to refuse a refund.
Section 75 of the CCA only offers protection in the event of a breach of contract so there is no point in contacting your card issuer to pursue this route.

Can you resell the tickets yourself?

Ah, that's disappointing, I could attempt to resell but ideally I'd like to just cancel the transaction, it is still less than 12 hours ago haha

Lets hope someone in their customer services have a heart and are not having a bad day when they reply!

Is there some reason why standing tickets are no good for you? I can't really see why you don't just go, you clearly wanted to when you decided to buy the tickets in the first place.

Maybe ask if you can upgrade to seated admission instead of GA

As these would be third part tickets, I would assume you wouldn't be able to upgrade.

Also, were able to get tickets in the seated areas at face value (around half price) directly from Alexandra Palace.

So ideally I would like the purchase cancelled and my money refunded, worst case I will have to try and sell them. I just assumed there would be more protection when purchasing with a credit card.

    Protection against what exactly?
Viagogo have done nothing wrong so far so irrespective of your payment method, there has been no breach of your rights for any one to protect you against.
  • Indeed everyone is correct. The sale of concert tickets is final, usually once they have provided written confirmation. Today this is usually an email. As this is comes through a few seconds after the online transaction, you probably had about 5 seconds to call up and cancel the booking.

Unfortunate indeed, perhaps there is a forum of Facebook page where you could on the night exchange tickets with someone else who wants standing instead of seating?

    I don't think I've stated they've done anything wrong.
I think what I've written so far implies I simply meant I hoped obtaining my money back would be more straightforward. I'm well aware this is more a case of me changing my mind/not taking the time to fully understand exactly what I was purchasing rather than anyone intentionally misselling.

Changing your mind on the day of purchase before any goods or money have swapped hands would hopefully, in a reasonable world, be okay. Again I'm aware we don't always live in that type of world.

This looks like it will be probably be my only option, I may try and re-list them with Viagogo for what I paid, hopefully they'll be people willing to pay the higher costs...

A lot of this all comes down to touts inflicting panic buying on people because they hoover all the tickets up. Hopefully more artists/ticket distributors will adopt a system that only the original purchaser can use the ticket and that there will only be one official re-seller.

At least that's what I'll consul myself with rather than blame my own panic buying haha :wall:
  • I too have been deceived by viagogo to the tune of £2342.35. I bought theses tickets on January 26th believing they were £80 each and found I was tricked into paying £350.00 each, plus booking fees, handling charge and VAT. All was not declared until I got the confirmation email anyway, could you please let me know what Viagogo's email is as I can't find it anywhere and as hundreds of other dissatisfied customers have said. "They can't contact them. Thanks in advance.

    Same person?
This morning I went on Viagogo to purchase 4 tickets for Ed Sheeran. I found 4 at £345.00 which I purchased but on completion of the transaction my bill came to 2183.75euros. I have contacted Barclaycard who said i'm well within my rights to cancel as I have tried immediately after. Viagogo are saying I cant cancel. this is extremely upsetting for me as I simple can not afford this amount of money and had I know the full price earlier in the transaction process I would of cancelled and looked at other options. this only happened this morning surly I am eligible to cancel this transaction as its obviously false pricing as one was in GBP and the invoice is whey more money and also in euro's . please help me as I don't know what to do?

If so you weren't deceived, you failed to read what you were buying.
