Private parking fine, 2 things wrong, where do I start?!

Hi all,

I received a parking charge earlier today. There's 2 key aspects which are wrong, but I'm not sure which one to go down. The parking behind our house is complicated. There's a pub car park with one service road going from the road, to the entrance. People park on the service road. Off the road on one side is flats with private parking. ( by Nighthawk, with signs up) opposite the flats on the service road is a patch of land, about 20m x 2m that I thought belonged to the pub. No signs, or anything. Cars park there all the time. I hope I've drawn a reasonable picture.

Today I walk to my car (parked on the patch of land) and find that someone this morning has put a sign up against the fence from Nighthawk, and then given us a penalty notice of £100. I've parked there for 3 years with no signs or anything, can they put a sign up and immediately ticket me? And how can I prove they just put it up?

And secondly, the contravention as listed is that I've parked in the flats with no permit. There's a whole road separating where I've parked, and the flats, so the location is wrong.

I've read the newbie guide, and plan on appealing in 3 weeks, but was wondering which avenue to explore. To say I'm annoyed is an understatement!!

    "Nighthawk parking", trading name of P4Parking. Member of BPA. Company number 06751164, address is "appeals team PO BOX 71107, London se18 9lb". No other address, online appeals form for me to fill out though..

    however nighthawk is not a trading name , its a completely sepersate company with a different company number NIGHTHAWK do not have access to the DVLA

    On the ticket it says that Nighthawk parking is a trading name though? On the ticket it says that if I don't pay then they'll request details from DVLA and a NTK issued.

    umm nighthawk have a company number 08181783

    p4 parking have company number 06751164

    nighthawk have not got access to the DVLA

    P4parking have got access

    a company that is not registerd with an ATA cannot access your details from the DVLA

    P4 parking cannot get info on behalf of nighthawk

    if you recieve garbage thru the post , the DVLA need to be asked questions , as do the BPA ,

    nighthawk are unregulated and do not answer to any ATA , one might ask on what authority P4 have in taking the debt over ?

  • Thanks Redx, so puzzled by pappa golf, saying they can't. I've read the signs section saying that the signs must be up prior to the action of parking there, but my concern is how to prove it!

    you allege it in your popla appeal and its them that have to prove they complied with the BPA CoP on new takeovers and new signage, and signage RARELY complies with the CoP anyway

    you are the appellant , not the claimant , so anything you say they failed on , they have to prove otherwise, not you

    how can a company (company number 08181783) get your details from the DVLA if they are not registered with a ATA?
