iPhone battery fault

Hi, can anybody assist with an issue I'm having with Apple please?
My phone is out of warranty now as it is about 15 months old. For a couple of months (but only since the warranty expired) the battery has been draining fast and it will shut down on anything up to 50% battery.
After a trip to Apple, several web chats and phone calls they have admitted it is one of a batch with faulty batteries. They have said I can send it for repair but I will be without a phone for a week, (not acceptable as I have a baby and need my phone at all times), or I can go back to a shop. The problem with going to a shop is it is so inconvenient, I cannot get an appointment as they are booked solidly for a week in advance and appointments are snapped up almost instantly. In the meantime my phone just dies at any point in the day and is becoming a real nuisance.
I asked Apple to replace the phone instead by courierinf a new phone and taking back the defective phone and initially they said they would but now they have said I would need to be under Apple care to do this.
Thy have said my Consumer Rights lie with o2, and o2 should replace the phone or arrange a repair and provide a loan phone while I wait, they have said I have rights for six years from the date of purchase. O2 will not help me as I am outside of the 12 month warranty.
Can anybody help me please?!

Your contract is with o2 as they were the retailer.To have a claim with o2, you need to have an independent report claiming the phone is inherently faulty. Have Apple admitted in writing that your phone is one of those with an inherently faulty battery?
With this report, o2 have the option to either refund, replace or repair. If they refund, they can deduct a percentage for the 15 months use you've already had.
If Apple haven't admitted its an inherent fault in writing, you will need to commission your own report to take to o2. If the report does indicate an inherent fault, o2 will have to refund the cost of this report.
If they repair, they do not have to legally offer you a loan phone.
For the sake of ease, can't you borrow or buy a £10 basic phone whilst yours is sent to Apple?0 -
It's only a week though to be sent back. If you really can't manage without one for that long (although I must be honest, I'm not sure why not even if you do have a baby) is there no one who's got an old one you could borrow for the durations with a payg sim?All shall be well, and all shall be well, and all manner of things shall be well.

Wouldn't have to send your sim card off, so its literally just any old phone (same network/unlocked). Doesn't have to be all singing all dancing.0 -

They have said I can send it for repair but I will be without a phone for a week That's the standard time to repair, unless you want to take it to someone non-approved by Apple., (not acceptable as I have a baby and need my phone at all times)You don't - and you can buy a cheap PAYG for under £20 to tide you over, or lend one from a friend., or I can go back to a shop. The problem with going to a shop is it is so inconvenient, I cannot get an appointment as they are booked solidly for a week in advance and appointments are snapped up almost instantly You can usually drop in at the opening of the store on a weekday and get a walk in appointment - you can at both Manchester stores. . You have no right to a replacement, they have offered to repair and you chose not to take this. And they are right that Apple Care would have covered it, but you didnt take this out.

Take the week long repair. You don't need a phone 24/7, regardless of having a child or not (I am self employed, and a carer for three family members and I could do without a phone for a week), and you can either purchase a cheap PAYG or lend a basic phone from friends/family - most have an old one rolling around the place.
You aren't entitled to a replacement. They have attempted to remedy by offering to fix it (because it does need to be sent off for repair) and you have flat out refused this.0 -
They have offered you 2 perfectly good solutions which you have rejected, what more help could anyone on here possibly give you.0

To everyone saying how do people manage without phones, presumably at some stage people managed without electricity, do you not use that either? I don't have a house phone so if anything happened to my child and I needed an ambulance I would be stuck wouldn't I? Thanks for the unhelpful replies though!!!

I haven't flat out refused a repair, I can't not have a phone for a week as I have no home phone and couldn't contact anyone if I had an emergency!0
