So I accept that if the op wishes to demand a refund via the short term right to reject then the onus is on the op to prove the damage was present on delivery. (Which I accept is all you were saying.)
However for the benefit of the op do you agree that if the op wishes to demand only a remedy [either a replacement, repair or a refund] at the retailer's choice then, if the retailer wishes to deny that remedy the onus will then be on the retailer to prove the damage was not present on delivery?

Yes, however it's fairly reasonable, given that the sink has been in the customers possession for over 2 weeks that on the balance of probabilities it'd likely to have been damaged since it was delivered unless the OP has prove to counter this.True enough.

I agree that it would have been better for the op if the damage had been pointed out immediately.
However in the op's position I would not be too concerned about failing to check the sink on arrival. I would be more concerned about the nature of the damage since it does not sound, to a layman like me, to be consistent with a manufacturing problem or to have arisen in transit without the packaging also being damaged.0 -
Thank you for all your help .. sorry has been tricky without running drinking water and a kitchen sink with 2 poorly children!!
This is the sink as we opened it.... (it was not 2 weeks that I had it ... it was just over 2 weeks since I ordered it but had only had it for 10 days and left where the courier placed in at the front of the garage)

I have had a friend (ex solicitor) put together a letter which went today guarenteed next day delivery. I also have the option of claiming on the credit car but need to wait for 30 days which is the week before Xmas.. not sure I can cope that long without a kitchen sink.
