Smashed sink...

I am having a new kitchen. I chose a Blanoc silgranite sink and bought online (with credit card!) it said allow up to 10 days for delivery and as I knew it would need to go in this week ordered it about 2 weeks ago. It only took a couple of days to arrive and we left it boxed as my 'kitchen' chaos and to keep it safe.
So it was unboxed today, less than 2 weeks after delivery and the sink is completely shattered. Company refusing to take any responsibility as saying I should have unboxed and checked! Builders are shocked as they say common practise with such items to keep boxed until required.

    Surely you would have noticed a box full of shattered pieces. Put it this way can you prove that someone, including your builders, haven't dropped the box.

    Golden rule is always check your items within a short period of delivery.

    where abouts are you in uk and what colour sink, got a couple of blanco sinks in garage from clearance sale
    Mr Generous - Landlord for more than 10 years. Generous? - Possibly but sarcastic more likely.
  • Box was left in front of garage exactly where courier left it and appeared intact. To damage a granite composite sink the way this is broke they would have needed to use some very heavy duty tools and would have taken some work! They quoted for job so any time delay would be in theory down to them so highly unlikely they did the damage!

    Do you have accidental damage cover as part of your home insurance?

    And the onus will be on the OP to prove that the damage was present on delivery. Something clearly he's unable to do.

    Why do you say the onus is on the op to prove?

    My understanding is the opposite i.e. the onus is on the retailer to prove on the balance of probability that the goods did conform to contract. In other words, in the op's case the onus is on the retailer to prove the damage was not present on delivery.

    That doesn't apply to the short-term right to reject.
