Rear End Accident

Hi everyone
Today 5 Dec whilst running my sister home from hospital a taxi company owned vehicle rear ended me with some force damaging the tailgate of my 2001 Kangoo which will know not open. The insurance company are saying they are going to right it off. This vehicle up till now has been faultless and only has 84000 miles on the clock do we have to accept a really low offer which I know they are going to come up with or can I ask them to acquire another one for me.

    They have to give you enough to purchase a similar vehicle in your area, start shopping around and gathering details
  • You can let them write it off, request to buy the car from them and run it as a categorised write off. I imagine your insurance premium will increase.

    BTW I have no idea if I'm right or not, I read this info on these forums....

  • What you need to do is to start looking around for similar age, mileage and condition vehicles so you have a ballpark figure for how much yours will cost to replace.
    From a quick look on Autotrader it seems to be somewhere around £4000 to £5000:

    If you are offered considerably less than this, use the adverts to try to get the insurer to up their offer.

    They have to pay you the fair market value of it immediately prior to the collision. A quick look at Autotrader confirms that - wheelchair conversions excluded - yours would have to be very tidy indeed to be worth much more than a grand or so.

    Not unless your policy gives you that option. Some do, most don't.

    If you think it can be repaired, take the payoff then buy it back for pennies. If it won't open, it might just need a bit of brute force and idiocy.

    You are having a laugh.
    Firstly, there's no mention of it being a Kangoo van, so we can probably assume it's a Kangoo car.
    Secondly, the first two vans in the results of your search are below a grand and a half - yet are still several years newer than the OP's car.

  • Fair enough if it's a car and not a van but the OP still need to do as suggested and get a few printouts of similar vehicles for when they receive their first offer.

    Thank you everyone for replying. By the way its what they call an estate car.
    I have spoken to the insurance company this morning and they are saying they have found a couple on Auto Trader the same spec for £950 which is somewhat less than £1200 I found them for. He admitted they are all up country there is nothing in our area. I asked that if we had to go up north to get a vehicle would they pay for travel and getting the vehicle home to which they said no. This vehicle had a new exhaust in September at £205 has a full service record runs like a dream and no recommendations on the last MOT. Bearing in mind it would go on for at least another 50,000 miles equating to 11 years of driving for us this would, in most probability, out last my husband and I being in our 70's.
    No matter what, we are going to lose out for something which was not our fault to a driver that never once asked how we were and said it wasn't worth claiming for!!!!!
    We are now taking it to our garage re the door and going to ask them to do an estimate for the value of the car.

    If you don't want to be out of pocket then you should have paid more for an agreed value policy, or one where they source you a car. You didn't so sadly it's up to you to fight your corner by getting as much evidence (equivalent cars) as you can.
