"16 Disabled motorists
16.1 The Equality Act 2010 says that providers of services to
the public must make ‘reasonable adjustments’ to remove
barriers which may discriminate against disabled people.
16.2 ‘Reasonable adjustments’ to prevent discrimination are
likely to include larger ‘disabled’ parking spaces near to the
entrance or amenities for disabled people whose mobility
is impaired. It also could include lowered payment
machines and other ways to pay if payment is required:
for example, paying by phone. You and your staff also
need to realise that some disabled people may take a
long time to get to the payment machine.
16.3 Operators of off-street car parks do not have to
recognise the Blue Badge scheme. But many choose to
do so to meet their obligations under the Equality Act.
Although a Blue Badge is not issued to all disabled people
it is issued to those with mobility problems. So it is a
good way for parking operators to identify people who
need special parking provision.
16.4 You are at risk of a claim under the Equality Act if you do
not discourage abuse of the ‘disabled’ spaces. This means
that you need to make sure the spaces are regularly
checked to be sure they are not being used by people
who do not have a disability.
16.5 If your landowner provides a concession that allows
parking for disabled people, if a vehicle displays a valid Blue
Badge you must not issue it with parking charge notices.

I have never known about the equality act until today. I have been reading up on it to try to relate it to this case which i can then use as a defence.
You are right they have ALL gone against the act so it seems.
I am so so happy you and others have brought it to light.
I cannot believe how corrupted and damn right inconsiderate these companys are. EVEN an independent appeals team. Which clearly are on the side of the parking companys.
Thankyou so much for helping to clue me up as i really am not very clued up at all0 -

time to stir things , contact the housing assoc and ask if they abide by the equality act , and are companies they employ empowered to , if the answer is YES then quote the BPA , (last para) an state that they have failed and what are they going to do? , remind them that IF this ends in coult , you will bring a claim against themSave a Rachael

The Housing Association will be jointly and severally liable for the actions of their Agent, Wing Parking, for an egregious breach of the Equalities Act 2010.
They bring this on themselves. All they had to do was accept the mitigating circumstances and cancel the charge at the first opportunity - when you appealed the ticket. No-one would complain about that.0 -

Again i cant thank you enough today has been an amazing day for me thanks to you and all the others who have helped.
First thing in the morning i will be in contact with the housing association L&Q to discuss this and find out about there commitment and their contractors to the equalities act.
This has been freaking me out so much but now i can find a breath of fresh air of hope.

The main defence, should a claim arrive, will be the Jopson style defence (search this forum, several have been written this past 3 weeks). The Equality Act (NOT Equalities) can be mentioned but at small claims you are best using the fact a tenant has a right to peaceful enjoyment of their property.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
