    Also i am having a google and a read on the jopson v homeguard case at the moment to try and clue myself up.

    Cant help but think of the worst especially at a time i have lost my job and only income.
    We do not think the worst, these cases are ones where the defence can be VERY strongly in your favour. Reply on this thread if you get a Court claim (Wing are not really known for it but if they try, it's defendable).

    You can relax, and yes, the Jopson case supports you!

    Thanks for helping.

    My grandmother has a disabled badge however signage does state the "blue badge holders are not exempt from parking conditions and so must use the disabled bay allocated"

    Only issue is there is only 1 disabled bay on the housing estate of which was occupied and frequently is occupied by another disabled tenant.

    It was a choice of disabled badge or permit at the time.

    Because the ONLY disabled bay was occupied my grandmother gave me the permit to use.

    As far as im aware thats the only rights my grandmother who is a resident of that estate that wing parking manage. Its either 1 disabled bay or visitor parking permit.


    Im sitting back now trying to research just incase. Im nogood with counter claims infact i would not know where to start or even defend myself if worst came to worst

    relax , plenty of people can help you if this gets serious, its not at all serious at the moment

    yes do the research and get pictures of signage and copies of paperwork , keep copies of the pcn and the popla appeal and rejection etc

    get copies of the lease and tenancy agreement , plus any disablement entitlement of this grandmother , plus get her to sign a witness statement that details what she needed on the day (help to get her from her parking bay to her flat etc due to being disabled under the EA2010)

    get copies of her BB as well (front and back)

    then , if you get an MCOL from Northampton county court business centre , come back and reply on this thread for help and advice

    and only an official MCOL, not debt collector drivel

    there may be a counter claim under the EA2010 for this too, if it comes to it

    yes popla case was put on hold from early 2015 until late 2016.. i asked popla on phone without revealing myself and they said Something to do with beavis.. which i have no idea what or why.


    It went ahead and was rejected at the popla hearing

    Got a popla letter explaining this which i ignored then went to ZZPS and then WH and now LETTER BEFORE ACTION which i contested as didnt explain who was the client they qere acting on etc

    THEN

    recieved a signed letter which my original post explains word for word..

    God knows what it all means or where its going but here i am worried sick trying to clue myself up

    ahh , so the company that did your indipendent appeal , are now working with the parking Co to take you to court ?

    very indipendent was,nt it.


    no help to you , but was the inevitable outcome of the handing over of appeals to WH

    Is your grandmother a tenant or does she own the property?

    Try and dig out the paperwork relating to where she lives.

    How long have this Wing Parking outfit been managing the parking there?

    How big is the estate, and is there literally only a single disabled parking space marked as such?

    - more than 50 parking spaces = 4% should be disabled, so at least 2 spaces.

    Unfortunately in my appeals i did say i parked, i then proceeded downstairs with the permit and i also said i then showed the attendant who then said it was too late and best to appeal.

    I guess i have admitted i was the driver.
    In this case, not the end of the world, as you aren't necessarily relying on being the RK and not the driver anyway.

    No need to panic.
