    What is your current position with affording the rent? Have the arrears only occurred since your grandfather passed away or before?

    I don't know why you're focussing on whether the guarantor can be held liable? If yes, then it's an awful position and presumable you'd pay your grandmother back, if no then presumable you intend to pay the landlord?

    Therefore, you will be the one paying it regardless of the legalities of the guarantor setup.

    What caused the arrears and was it a temporary problem or an ongoing problem? The answer to that is what's needed to help, not whether the guarantor agreement is binding.

    Correct, the estate is only liable for debts as at his date of death, so grandmother doesn't come into it otherwise.
  • This sounds like a stressful situation for you and your partner. I think your main priority is to come up with a realistic payment plan for your landlord. It's likely that the landlord can pursue the guarantor's estate for outstanding funds. If the relationship is still fairly civil between you and your landlord then perhaps ask for a short amount of time (a week or 2?) to come up with a payment plan. In that time you can speak to your grandmother and let her know the situation. It will be much better coming from you than your landlord. I hope you find a solution!

    Despite grandad being a guarantor surely they can chase OP and take her TV away etc? I assume it's chase debtor, then guarantor?
