GB vehicles contracts- excess mileage dispute

So I took out a C class on lease via GB vehicles over a 3 years period.

The deal we agreed on was for 15k miles, however after retuning the car whats come to light is when GB vehicles arranged finance with Mercedes Benz, they ordered for 10k miles.

Now after lease expiration, I am being hit with a bill of an excess 15k miles from mercedes benz. GB vehicles have essentially turned around and said they'll contribute £300 as a good will gesture rather than pay the outstanding £1600. As I signed the finance paperwork, its between myself and mercedes and nothing to do with them, despite them organising the entire deal.

Their is a clear email trail showing discrepancy from 15k to 10k when the file was switched from one colleague to the next. I highlighted the oversight via telephone to the individual I was speaking to, who said the mileage can be retrospectively adjusted once I had signed in order to release the car. The call was not recorded unfortunately.

They have dragged their feet for almost 6 months now and I am facing legal action from Mercedes Benz for not settling the oustanding invoice. GB vehicles were aware and did agree to settle the invoice at one stage, and have now gone back on their word.

Has anybody got any advise on how to deal with this situation, or if I have a case to take them to court if they continue to refuse to pay the outstanding balance. I am not willing to have my credit rating tarnished for their error. By my calculation I owe Mercedes £50 for excess mileage the rest is down to GB for making the error.

    I assume you signed some paperwork? What does it specify?

    How much extra would the monthly cost have been if the lease was correctly arranged for 15k miles a year. You have paid less each month than you would have done if it was correctly set up.

    I would say that what GB owe you is any extra you now need to pay, £1600 less the extra monthly payments you have saved. Wouldn't be surprised if the £300 was about correct

    I have just run a couple of comparison figures and the differential between 10k and 15k will be over £1,300. About £30-£40/month + VAT.

    I also learnt the hard way you need to read these contracts with a fine tooth comb and take what they say on the phone with a pinch of salt otherwise you end up in this situation. (With me it was £500(ish) VED that was suddenly not covered).

    So you knew three years ago that the lease you actually had in place was for 10k, and there was a verbal agreement in place to increase the mileage once the lease was in place, but you then let that slide and didn't chase it up?

    What was the difference in monthly lease price between 10k/pa and 15k/pa?

    Yes, I know you had a rough number on today's prices - I'm asking the OP what his lease difference, 3yrs ago, was. He must've been given a difference, when discussing the figures...

    Sounds to me that the OP was fully aware that the contract was for only 10K per year from the off and failed (possibly deliberately) to chase this up later. At the end of the day OP, you gave your agreement to the terms by signing the contract, the only one legally responsible for the excess mileage charges is you I'm afraid to say.

    The original invoice I took out with GB was for 15k miles and I have been paying that for the entire lease agreement. I paid the higher rental for the extra miles.

    Finance work came through a few days later, and only at the end of the agrement after returning the car has this issue been highlighted by Mercedes. Never trust a salesman I guess.

    So the finance agreement came through and you failed to read it?
  • Pretty much, I trusted him as the broker who had my money and I took him at face value assuming he knew what he was doing.
