Terry takes on ASDA - peterbourough news story

After searching Facebook for advice on appealing the fine he then searched Peterborough City Council’s planning portal and discovered that the parking signs had not received planning permission. He then contacted Nigel Barnes, the council’s planning compliance team leader, who wrote: “The new adverts on the lamp posts in the car park of Asda at Viersen Platz are unlawful and will remain so until such time as any future application is approved.”


And this from the Council:


Peterborough City Council will not take enforcement action despite telling ParkingEye the lamp post signs are a “few centimetres” too big. A spokeswoman said: “In cases like this, where we would likely approve the change to the signs, the advice from government is not to use our enforcement powers and to work with the landowner to achieve compliance.”
From the Plain Language Commission:

    So the council will not enforce the law, but let bullies enforce their own versions of scammers make believe laws!

    What a total farce, if a homeowner didn't conform to planning laws it would be a different story.

    This works both ways, as Peterborough council say ...

    "The new adverts on the lamp posts in the car park of Asda at Viersen Platz are unlawful and will remain so until such time as any future application is approved.”

    A statement to be shown to a judge.
    All tickets issued in that Asda store should be returned to Asda for them to cancel as they are responsible for their operator who are acting unlawfully.
    I guess the ultimate would be to take Asda to court.

    This will not be the only Asda and everyone should check this out regarding their local Asda.

  • Pity I'm not in Peterborough, a while ago I tied a "Christmas Trees" sign to the legs of a road sign and got a right b/*llaking from Highways.

    I would rather go to court than pay a penny to parking lie, they should not be allowed to flout the law!

    In due course it will be interesting to see whether PE do pursue any Asda case to court, or whether there is an Aldiesque restriction.

    IIRC Asda fell out with/didn't renew the contract with Smart Parking last year?

    I wonder when the big national retailers will start to recognise that the only people who benefit in any way from ANPR parking are the PPC owners. And Will Hurley/John Davies...

    It's not that long ago that supermarkets didn't have parking sharks, and I don't ever recall seeing apocalyptic scenes of carmageddon in any of them.

    Generally signs of 0.5m2 or larger require advertising consent in the UK. Not having said consent is a criminal offence.
