There's also the minor point that you are required to give your residential address when responding to the forms. How do you imagine your service would get around that? If the answer is going to be "they give our address instead" you're setting your users up for a lot more potential trouble than a CCJ would give them. Essentially when someone receives a CCJ claim form (Money Claim online ones, not the Manchester bulk centre (paper ones) the person has the option of selecting an address for service of documents other then the address on the claim form. Yes - the key thing here is "Service of documents" - the address on the claim form remains.
If this is selected this means that:
1. The AQ is sent to the service address.No such thing as an AQ any more -it's now a Dkirections Questionnaire - has been for around 2.5 years.
2. Any further directions from the court are sent to the service address. Correct
3. If judgement is made this is sent to the service address. Correct - but the address for the debtor on the court file is still as given on the original claim documents
Therefore since the CCJ is at an alternative address Wrong. It isn't. The documents have been served on the alternative address, the address on the CCJ itself remains as the person's own address, as reported by the claimant and this address has no "credit" links to the original address then the CCJ is NOT on that persons credit file. No linked addresses on Experian etc. Oh yes it is...
How do i know this has worked? You don't, you're blagging.If it has worked, then someone at the court has made an error, a significant one at that. I wouldn't rely on it happening again though
10 CCJs dealt with using a service address. Each one resulted in a CCJ at an address other then the address of the original claim form.
Credit files checked and no ccjs at the original addresses. Trust online also confirmed this to be the case.
Perfectly legal.
As an example - someone uses their Solicitors office as a service address. Quite routine, that. Do you seriously think that the court honestly imagine that person resides at their solicitor's office? And if your scheme DID work, I hardly imagine that solicitors would be content to have their addresses used in this way, do you?
Oh,and if you're even thinking about the idea of suggesting to users of your "service" that they claim that their residential address has changed, to the false one you will be using, I really wouldn't. You'd be encouraging them to perjure themselves. Given the option of a CCJ, over a very lengthy prison sentence, I wonder what most people would choose?
