    Well I have submitted the appeal (last Wednesday). Haven't heard from them yet. Any thoughts about the reaction it is likely to get? Do these companies typically reject all appeals or are they likely to accept that they were out of time and not drag things out further.

    Just got a long reply from Gemini rejecting the appeal. They responded in detail regarding arious aspects of the case of Parking Eye vs Beavis. Strangely, they did not make any mention of the parking notice being issued beyond the 14 day period. In their response they claim the parking notice was issued at 23:22:51 on 24 Nov 2016. Need to figure out what is required for the next stage of appeal to POPLA. They included a form, but this didn't include any option to highlight that the pcn was issued (posted) outside of the 14 day period.

    they can say it was typed whenever they want, however you have proof that it entered the postal system , in your words "it was franked on 25/11/2016 " , 25th was a friday , and 2 working days is the following monday the 28th

    Am just looking through the threads to see if the popla appeal just needs to highlight the "out of time NTK" issue and keep it brief.

    loads of appeals look in completed cases , basicly if they have failed to post in time they cant hold you as liable , only the driver , hav,nt checked , but you have not admitted driving to them have you?

    what happened when you complained to the venue?

    Haven't made any admission as to who was driving, appealed to Gemini as registered keeper. I didn't get around to complaining to the venue as the NTK arrived at the end of November, and December was a bit busy.

    ok , photocopy the NTK , write your email on it , GIVE it to the manager , not the help desk , tell him you are %issed off and unless sorted you will never use the place again and tell your friends , drop the staff in it for not telling you about the extension , hand him the COPY and tell him to get it cancelled and email you
    do it ASAP , if hes not in , go back , just do it

    nasty comments on facebook /twitter about how it costs £1xx for a 2 hr session will not go down well

    I had got the impression that since the charge was not enforceable due the the NTK being out of time that the Popla appeal would be successful and there would be no need to follow the route of complaining to the venue as well.

    why worry about a 50/50 chance of winning at popla , hell they are giving out some stupid replies , get it killed by the venue first!
