Hi all, apologies if this is or has been covered have been unable to locate anything similar
Have many many people hit with INDIGO NTD
NTK issued by ZZPS with PCN ADMIN (all zzps address details etc)
ZZPS chasers
WH - formal letter of claim - ZZPS identified as client
WH - formal letter of claim
CLAIM FORMS
i take issue with ZZPS being involved seemigly pre notice to keeper for one
then obviously the confusion WHZZPS bottom left of docs denotes the dubious use of legal headed paper by WH
However as claim forms followed this must be WH also
Anyways now for something a bit more interesting
Many DVLA Subject requests undertaken, all coming back with identifying query numbers and some letters denote data requested by INDIGO PARK SERVICES these are enquiries made on behalf of a local authority
Now to my knowledge Local authorities and police get free access to data KADOE or not
However this land in question is private land so surely this is not allowed? Any feedback very welcome as i am collating defences for roughly 70 people at present for this very same site, and i want to take these puppies down

INDIGO are a BPA AOS member and so can have a KADOE contract with the DVLA to pay to access keeper data (as can all the others with AOS status)
if they dont have reasonable cause its possible they may be in breach of the DPA and so a complaint could be made to the ICO id the dvla conform it
in that case INDIGO could be sued due to a DPA breach
its also more complicated if the land is not relevant land under POFA2012, so railway stations etc , where byelaws prevail
so all depends what site it was on , plus where in the UK it was too
ZZPS are mere debt collectors and can be ignored0 -
The subjects you are dealing with have been discussed at great length in numerous threads. To suggest you can't find them is a little worrying or was it that your were simply overwhelmed by the number of them?

ZZPS - as a simple debt collector - have no standing and WH as solicitors should be well aware of that. If ZZPS are being recorded as the Pursuer in these cases then that is a no-no and claims should be being dismissed - or applications made for them to be so.
The issue of who has conducted the initial RK enquiries with DVLA is interesting but I suspect that this is because Indigo has a single route by which these are done and they are failing to differentiate between the LA and private cases - that in itself is not a granny-stopper. It doesn't mean that they should have got away without paying the appropriate fee.
If you are suggesting that as many as 70 people are currently being pursued - presumably through the Sheriff Court over private parking issues then I suggest that you contact the Parking Prankster - prankster@parking-prankster.com or the BMPA - contact@bmpa.eu as a matter of urgency.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

It's a hospital site in Wales classed as private land not local authority. Indigo have more than one access point of kadoe just was very interested that they have used the free path when obviously it should be paid for.

Idea and revert to just the hot bread ?!
Although the situation I have noted doesn't personally affect me I spend a lot of my time assisting others.
At present the setup of this transfer of data after notice to driver to the debt collector zzps at such an early stage and the consequent harassment of those affected by telephone calls and texts and emails from them and wh I find extremely annoying and I would really like to rock the foundations out of this at first defence stage. So looking for guidance to anyone that has noted these anomalies. In a response to letter before claim I have stated that as they have been instructed by zzps they as legal professionals should know that the client should be indigo not zzps and a change in further documentation would put them in a dubious position and a possible conflict of interest arises also

I'm not convinced that there is anything anomalous about the apparent early transfer of data to ZZPS. Much like its predecessor organisation - Roxburghe - ZZPS offer what amounts to a back-office service for PPC's. They are not acting as a simple DCA in this situation. This arrangement (third party data processing) is specifically allowed for in the KADOE contract at section D5.1 so - provided there was a contract in place between Indigo and ZZPS prior to the transfer of data then they would not need to obtain permission from the DVLA for the transfer.

its the accessing of the data from the DVLA via a non fee paying KADOE Local Authority access point i am interested in - with tickets they have not paid to the DVLA £1,307.500
