  • Thanks again sourcrates. I did approach creditors direct, by template and obviously got rejected by post.( including the annoying means testing paraphernalia ).
    Would a phone call to each creditor , be the next best way forward.?
    I really cannot be doing with this means testing , when all I want to do is a settlement figure that is not too painful.

    By all means make agreement on the phone, just make sure it's backed up in writing.

    Something else , just crossed my mind: could I be in a situation where 1 creditor accepts/ another one declines etc ?

    The way to avoid that is to keep the process open till they do agree and your happy also.

    These things are seldom trouble free, but most people get there in the end.
    The annoying thing can be a creditors reluctance to negoatiate, one of mine was like that, got so fed up, forgot the whole idea, went with IVA instead !!!

  • Received email this morning. My annual review is due.
    I haven't opened it, as I'm in bed. I will probably give them a call on Monday , if they don't call me by then .
    To avoid tangling myself further , I will ask them what is the lowest the creditors will take as full and final and take it from there.
  • Just called them . I have appointment weds 8th of Feb 11 am.
    Seemed weird giving my old address etc as security questions.
    They requested the usual (mortgage details/ wage slips etc.)'.
    I didn't say anything , as I thought I'd go the pedestrian and pedantic way .

    Sorry if I'm repeating myself , but as I'm not working and want to make a settlement , I will be direct and hopefully get a figure that's not too sad.

  • One other thing : Would payplan allow me to continue payments through them , if the settlement figure is not good for me?
  • Getting myself prepared for next weds . I don't think I'm in a situation to be means tested. ( no job, in rented accommodation etc)
    The downside is , if payplan know I've sold my home they may try to bully me into giving the full amount .
    I assume they will get information from my credit file on Experian .
    I'm hoping to be direct , and ask for a settlement straight away .
    A thought has crossed my mind to phone up the creditors with an increased offer. Not sure if it's too close to my annual review now to be doing that.

    AC - a number of people told you to be persistent when you made your first offers back in December. Just to reiterate no one can see your bank account and no one knows how much savings you have. They may be able to deduce you have sold your flat and how much you received but they won't know what you have had to pay out. They cannot make you pay anything - they have no powers. If creditors took you to court (unlikely as you paying under a dmp) then a court can force you to pay but this is not going to happen as you presumably have been making the dmp payments recently.

    My advice is to write to the creditors again upping the offers again by 10% or even 20% if it is within your budget to do that. No point in means testing you as you have no income at the moment. Don't disclose your bank balance and might be best to email or writes so you are not tempted to put your foot into it. You don't strike me as a very good poker player ;)
