Tesco 3 for 2 on toys cancellation

Could anyone offer any advice on this for me.

Purchased 3 toys on the Tesco 3 for 2

Toy 1 = £66.49 (reduced from £99)
Toy 2 = £56.99
Toy 3 = £45.00

Total = £123.48

Items delivered today but toy 1 missing, called Tesco and they advised toy 1 out of stock so £21.49 has been refunded.

feels like I've been ripped off somewhere as I now have £21.49 towards a £100 toy!!

I know they've probably got some small print somewhere covering themselves but could anyone offer any advice as I now have £21 towards a £100 toy!!

    There is no £100 toy the old price is irrelevant.


    Cancel the entire order, and get your money back if you're not happy, which is what I would do. I would even phone them up and tell them to pay the return postage as I would never have bought the 2 items alone in the first place so it's their breach not yours.

    Put quite simply, you have only purchased two toys so are not entitled to the '3 for 2' offer - but you already know that.

    You are right, they have covered themselves.
    Their T&Cs confirm that in your situation they have no obligation to supply the ordered goods:
    3. Acceptance

    Your order is an offer to buy from us. A contract is only formed when we notify you that we have despatched your order or notify you that your order is available to collect at the store (as applicable). At any point up until then, we may decline to supply the goods to you.
    I would suggest that your best hope is to negotiate with them to by a third toy to take advantage of that offer.

    I wonder whether it should have been heavily reduced plus in the 3 for 2

    If you feel that ripped off send the other 2 back and you will be back where you started and lost nothing.

    I think the same as above, that toy was probably excluded form the offer but they messed up.

    Unfortunately, the item being back in stock doesn't make a difference to your legal position I'm afraid.

    I'd go with the advice given. Return for a refund & ask them to pay the return postage costs (if they dont already offer free returns) or ask them for another toy from the 3 for 2 offer. Or I suppose as a third alternative you could ask if they'll honour the original offer on toy 1. If they say no, you could also ask if they'd do the 3 for 2 on the £99 price and/or whether they'd be willing to discount the £99 price any.

    Thanks all, I've sent them an email and requested they pick up the said two toys. I have also cancelled an order for Xbox one, tv and fridge freezer that I bought off them over the weekend so it's safe to say I've fell out with Tesco!!

    Are you cutting of your nose etc cancelling all the other orders

    doubt they will pick them up , have you asked for a free return if they don't already offer it
