  • A quick update. The FOS phoned this week and are now on the case.

    Here's hoping for some grace.

I had issues with them some years back. Off work on sick pay alone for an extended period. I contacted them to say i cannot make the full payment and they refused to do anything until i had missed a payment.

Then after the missed payment they demanded i pay £200 right now otherwise they wouldnt be able to help me. Capital one and MBNA were the same.
After one conversation where we just went round in the usual circles i just said whats the point and hung up. Then they sent me a letter saying they are trying to help and not their to antagonise me. I was fuming and never spoke to them ever again.
They sold the debt, hopefully for pennies and i settled at a much lower rate.

Learnt my lesson on credit though.

  • OP, I'm really sorry to hear of your issues with Capital One and also for some of the insensitive and frankly ridiculous responses to this thread. Unfortunately there are people in this world who rejoice in regurgitating their black and white views on things whether it's appropriate to the context or not. The same people who lack the complexity of thought to realise that the CRA system is fundamentally flawed.

I've never dealt with Capital One myself but my advice to anyone looking to clear adverse credit history is to go through the full complaint procedure with the company in question, be polite, calm but forceful and eventually the complaint will be escalated past the call centre idiots and to a team of more competent individuals who are able to make decisions. It seems like Capital One don't have this kind of team.

Once you've exhausted all avenues with Capital One, google their Directors and try to find the email address of the director of customer services or the ceo. ceoemail . com has most of them. I found details for the Director of Operations for Capital One UK on that site but it won't let me link it here for some reason.

Send them an email explaining the situation, keep it factual and as concise as you can, try not to let it sound like a rant. Explain it to them how you explained it in this thread, ie it was never your intention to not pay the balance. As you said you had to move in with your parents you probably didn't get any letters about it? It's worth making that point. Also explain that the gesture of goodwill has actually made things worse for you on a practical level than they would have been if you'd completely ignored the debt, they're successful people so will appreciate how the system is flawed.

Finally, explain in the email how the late payments are impacting you now, ie you're healthy again and back on your feet but you can't get a mortgage and all the other restrictions that poor credit history is causing you. I imagine that it's difficult enough to pick yourself up after cancer without then having this kind of thing to contend with.

This strategy worked twice for me with separate companies. 1 was a high street bank where they were 100% in the wrong and 1 was with a utility company where they were in the wrong but I could have done things to prevent the situation. Both were "accurate reflections" of the accounts but neither of them were an accurate reflection of my creditworthiness going forward. The same goes for your situation.

I hope you manage to get the payments removed from your account. All the very best.
  • Thank you so much.

You would think it would be easier in this life to manage admin and finances but it can cause so grief.
