    Yes, but it's still factual information. It's not arrogant to say that you don't get to get factual information removed just because it would be nice, nor does it make anyone refusing heartless. If anyone could get negative payment history removed from their credit files it would make the entire system pointless.

    I'm sorry but this is going to sound harsh op.

    My husband has had cancer for 8 years now and is just about to have a major op. Yes, it turns your life upside down for a while and things will never be quite the same again, but bills still need paying and admin done. It's a shame that you feel hard done by, but there is little flexibility within big companies to not follow procedures and be "kind".

    You say that money is the last thing on your mind when you get a diagnosis of cancer, but the first thing my husband did was get all the paperwork together and list everything that needed doing. Doing normal, boring jobs can be cathartic, but, as you demonstrate, everyone reacts differently to this sort of thing.

  • Do you need any credit within the next few years that means one default will hurt you, ie a mortgage or a new job? If not, just leave it. It's a pain but does it really matter?

    When they offer to set the default back is that starting fresh from 6 years again or back to 3 years ago?
  • You'd be better off getting it back to the default status as in just 3 more years the account will disappear from your credit report. I assume it is closed now?

    I used to work in something called the SSU for Capital One when it was based in Nottingham and it was for cases exactly like yours. We were able to actually do something as a result of a diagnosis like this and we could have helped out. Had you come through to me or one of my colleagues we could block the account and put it on hold etc for a period of time and work out how to go forward- possibly even have looked at a write off.
    Capital One in their wisdom fired us all (I jumped just before I was pushed- I got a job elsewhere) and shifted the department to India where the sensitive cases team it seems no longer exist and their collections team are equally aggressive (and useless- I had occasion to ring them and one of them really thought the Financial Ombudsman was a debt management company! I even had to tell him what screen to look in for something) to everybody. Hate to say it OP but I'm not surprised Cap1 haven't done anything, they are completely clueless now when it comes to handling sensitive cases.
    Seashore, I'm sorry to hear about your hubby but not everyone's first thought is 'I must pay the bills' Mine certainly wasn't when I got my diagnosis. I have developed a personality disorder because of the trauma I went through and in fact have had 34 debts written off because of my various medical conditions. You are very right though when you say companies aren't kind- see above for why this company isn't. They did however used to be but because being helpful and taking sensitive cases on isn't cheap and it's cheaper to employ people to aggressively chase money from people who are in desperate situations that's why!!!

    Agreed. I would use those standard phrases like "the need to treat customers fairly" and "the bank's duty of care".

    If that doesn't work, write to a newspaper. One of those trouble shooters may succeed where you can't...
  • You can complain to Capital 1.,..if you're not happy with the outcome then you can escalate it to the FOS.

    I have put in an official complaint and they made me jump through hoops - then they have made matters worse.

    Now it is with the FOS. Fingers crossed.

    I just want this over now.

    As I understand it, the account will only show as delinquent for 12 months after it has brought back into good standing. Having said that, if you have paid it off and closed the account it should now show as settled.

    Were the DD payments getting bounced by your bank for a year? Did your bank charge you for these, or did they write them off as a gesture of good will?
  • It is paid off and settled but shows as 3 years of late payments.

    Barclays were absolutely brilliant and pretty much held my hand the whole time. They waived a lot of charges and also gave me compensation for some of the hassle. It was nice to be treated as a human being rather than "these are the rules and you broke them".

    Capital One are cold and very heartless.
