thats what i was advised in the outlet i went to, has they tried to restore and reset they said they where unable to restore it and that it must be a hardware issue as they advised it was coming up with error messages

Apple "geniuses" aren't so much!! Hold both buttons until you get an iTunes symbol. Then restore from ITUNES, and let us know what happens, there is usually a way to fix most issues
