You need to get this escalated off the bottom level of the customer complaints department. Then I imagine you'll see some constructive action.
These phone calls are in response to a formal written complaint where I laid out their legal requirement to give me statements. Have received 2 years worth of printed out statements, but nothing else at the moment. My APR is 29.9% (!!!!!) and on many months the payment covered the minimum payment but was still less than the interest, which explains why the balance is reducing at a snails pace.TWBM 2010: 1) LCD TV 2)Hamper 3)Cash

Yep, that's what I thought! Also, I've noticed that they say they closed my account nov2014 due to a supposedly lost card, statements show my account was closed on April 2014 (with no contact or explanation) I've paid a couple of pounds under on 4 occasions (because I have to get passed from one dept to another to find any details of my account) and been charged fees, with no notice from them. I've had a final response from halifax. The letter states that they accept that they withheld statements for 25 months (although its 30 by my count), and that I rang 'numerous times' but was wrongly told I was not eligible to see a statement. They also admit they wrongly marked the card as stollen when it wasnt. But they finish by saying say that on my payment record, statements would have made no difference to me or my ability to pay and they have no intention of repaying any inrtetsst or charges over these months. Their final offer is £200. (They have charged me £12300 interest and charges during my time without statements plus the cost of numerous phone calls. . Any advice what to do next? The Consumer Credit Act governs the licensing of traders who supply credit or goods.
Section 6 of the Consumer Credit Act 2006 inserts a new section (s77A) whereby a statement must be provided if the agreement is a fixed sum credit agreement under section 77A.
The statement should explain the money borrowed, money paid, interest in all cases and the outstanding amount.
The creditor under a regulated agreement for fixed sum credit must within a period of one year (beginning with the day after the day on which the agreement is made), give the debtor a statement.
After giving that statement, the creditor must give the debtor further statements at intervals of not more than one year.
Failure to provide the statement.
If the creditor fails to give the debtor an annual statement, then he is not entitled to enforce the agreement during the period of his non-compliance, and the debtor is not liable to pay any interest during this period.
The debtor is also not liable to pay any default sum that would have become payable during the period of non-compliance or that would have become payable after the end of that period in connection with a breach of the agreement occurring during that period.
They cannot pick and choose which legislation they adhere to, I am amazed at this response to be honest, some re-education needed in their compliance dept me thinks !!!

Thank you. I'll do that. They've been so rude and made me feel stupid as they've said- you tell us you would have been able to look into consolidating the debt if you'd been able to see statements/interest etc, but on your payment amounts we feel that is very unlikely. i always paid, and surely if they felt I was struggling with the debt they should have helped me, not tried to belittle me? I have just read your thread and am absolutely furious on your behalf that you have been treated this way. It is not ok in ny way and someone at Halifax needs to take responsibility for this situation.
Previous posters have made good suggestions about how to proceed and I do hope you keep going with your complaints against them. It will be worth it in the end, just demoralising to have to do it. But persevere and keep us all informed about how you get on.
