I think the only way to see if this will work is for someone to use it as a defence point in a private parking court case where advertising consent does not exist.
A hard row to hoe unless someone is totally switched on with this stuff. I don't see many who come our way able to hack this one.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

It's been tried in 2 cases recently. The illegality of signs that didn't have planning consent
was the main point of defence but it wasn't put to the test as Parking eye baled out and withdrew their claims.
