She is claiming as a student so hasn't been placed in any group she gets 57.90 per week xx

Income based or contributions based isn't a group. It's whether she is getting it based on NI contributions (which she won't be).

The groups are the work related group or support group.

Hi I have phoned ctc again I have explained again and again I have been told they are not interested in my daughter income esa or another kind . They are only interested if she leave full time education so long as she in in education of more than 12 hours a week I can still claim ctc credits for her regardless of what her income is . I'm really confused I have asked them to make a note on my claim that I have called twice and sought advise other than that I don't know what else to do xx

You should not be getting to child tax credits for her.

You need to phone again and quote this:

But a customer will cease to qualify for CTC in respect of a young person, even if that young person qualifies under the previous conditions, if:

having ceased full-time non-advanced education or approved training, the young person starts remunerative work - that is work done in expectation of payment for 24 or more hours a week, or
the young person receives Income Support, Income Related Employment and Support Allowance, Income Based Job Seeker’s Allowance or Universal Credit in their own right.

I know how frustrating this is which is why I think you should actually quote from their own manual.

Perhaps Icequeen could tell us if notification of your daughter's ESA is passed to tax credits and because it is a recent claim then they haven't received notification yet.

Have you worked out the financial side. Do you lose more in child tax credits than the ESA?

Daughter would then be expected to give some/all of her ESA to you for her keep? How is it going to work?

If the tax people don't listen this time then it may be simpler to cancel the ESA claim?:)
  • I agree with above, quote their own guidance to them.

Yes they don't want to know about her income that part is true but they don need to know that she no longer qualifies for benefits as a child.

Thank you everyone . To update I have phoned ESA , CTC three times today and quoted what was said on here I was told twice that as ESA was her income and her claim it wouldn't effect her CTC . How ever on the Third call I was finally told that she could only be one ether an adult ESA or Child CTC so I have got her to cancel the ESA today . I still don't know how as a student who is in full time education can claim ESA successfully with out a sick note but she did. I just wish the school who advised her to do this would of also of advised that she cant claim CTC or CB at the same time would of saved me a lot of stress trying to sort it out . Thank you once again for all your help xxxx:T

but she doesn't claim CTC ir child benefit ... you do.

the school can only inform her of her own entitlement and not yours

Anyone can claim, but that doesn't mean it's been awarded yet. Could it be that your DD filed a claim because she wants to start being independent and manage her own money? Even if that leaves the family worse off overall, it's a good step towards learning independent skills, so maybe not to be discouraged. Of course, that would mean her contributing towards the bills.

Have you stopped claiming CB too?
