The general tone of Redx post was that I dont really stand a chance at an appeal?.. I'm also not sure I can handle the hounding/court case looming over me.
I'm in a bit of a pickle guys.
It's not just you, nobody stands a chance of winning an appeal with Excel, they will always dismiss it.
But, just because your appeal is refused, it doesn't mean that you have to pay them. If they want your money then make them work for it - you have !
Ask yourself this question, if you had seen properly affixed signs in full view stating that you have to pay for parking, would you have paid, or would you have 'chanced' it and spent an hour on site hoping that you were not caught out.
Wait and see if you become one of the unlucky ones that they attempt to sue before parting with your hard earned cash. Then come back here for further advice.0 -
as above, you have little or no chance with your EXCEL appeal , neither would I, its just the start of the paper trail (evidence) for any court to consider in the future
you might win on poor signage or frustration of contract or some other legal argument , or the fact that their NTK,s do not conform with POFA2012 so they should chase the driver (if known) - they dont know who was driving unless some numpty tells them (which many do even if they dont mean to do so)
there have been many court cases brought by EXCEL, VCS and BW LEGAL that have failed in court due to not following POFA2012 , poor signage as in the Martin Cutts case etc
its a well known fact that the signage is woeful at the PEEL CENTRE, which is why prankster blogged about it and highlighted it on his overhead map of the place
so its not just you , its anyone that appeals, to almost any parking company, the appeals are turned down due to profit before fairness
nobody is having a "go" at the OP, its tell it like it is so the OP can decide if they have the guts for a fight, I would due to the principles , others may not
but I still would never park on there

No you are not, thousands of people get these and do not pay.
I always say if you pay after getting our advice, knowing what it is all about, how do you think the little old lady/vulnerable family whose next PCNs YOU WILL HAVE FUNDED THE ISSUING OF, will feel? No-one can be proud of supporting this horrendous industry for an 'easy life'.

Excel cannot hold a registered keeper liable. CANNOT. So, be a silent registered keeper or send one challenge as registered keeper, not saying who was driving, then if they ever try a small claim (and they are not doing well with them right now!) the registered keeper wins as long as you can explain at a hearing why a keeper isn't liable.
Now go and edit your posts to remove any implication who was driving.
Then email the Peel Centre and tell them you and your friend who have ten (or whatever!) children/nieces/nephews between you and were about to spend a fortune at ToysR Us. But now you can't because of this awful 'fine' from what you have now discovered is a notoriously litigious firm who do not offer POPLA or any method of fair appeal to consumers.
As long as you say in your email: 'we did this, we didn't see any pay & display machine' (not saying which of you or your friend parked) then you can still remain in 'registered keeper' mode.
I think just before Christmas, losing a potential two families from ToysRUs major purchases might just push the Peel Centre to cancel this one to entice you back. Give it your best shot! No saying who was driving (EDIT THOSE POSTS ABOVE).

The peel centre is well wrapped up. The signage is crystal clear, they have ANPR cameras and foot patrols. Up until recently you could have half hour free just by taking a ticket. This allowed you to collect stuff. Not anymore, ANYONE be they disabled or not, has to pay to park at the peel centre
The minium charge is £1.30 for 0-3 hours.
Just pay the fine,you cannot win.
The answer is simple, boycott the peel centre. Go elsewhere.

Incidentally,. the peel group is 75% owned by Mr John Whittaker, a succesful businessman with a net worth of £2.3 Billion,,and his company are striping you mugs out of £1.30 to park to SHOP and spend money at a shopping centre his company owns !!

I disagree - it is far too wordy and the P&D machines are not obvious at all places (from photos seen). And the P&D machines are faulty!The signage is crystal clear
